My problem with your offer to scan two pages and email them to someone was less about copyright law than it was about treating the FHS fairly, but, as a matter of interest, in law copyright applies even when it isn't written on the publication.
You have now said that the FHS told you that they do not mind "copying of entries so long as it is not pages.." - but that is exactly what you originally offered, and are now saying you intend to do! It makes no difference whether all entries for one name are 19 or 9, but what the FHS has told you is exactly what I was trying to explain in the beginning. They will not mind if someone transcribes a couple of M.I.s or whatever, but scanning a whole section from a publication - the reason why most people would buy it for their own name of interest - is unfair. And no, this message board is not the family history society whose volunteers compiled the entries and paid for the publishing of the volume.
I don't know whether you saw what I wrote to Sandra, but this still applies. I wrote:

Most committee members of the IoM FHS do not use the internet, and have no idea what damage it would cause to their income if people think it is OK to scan and send on pages of information. It would certainly see the end of their publications, because why bother buying something in hard copy if you can find someone to scan everything of interest in it for you?
They have told you that they do not mind copying of entries so long as it is not pages, so I hope you will stick to transcribing one or two entries like everyone else, and not scan anything.
