Deed – NSS German Oct 1783-3

Articles of Agreement and Sale made and concluded by and between Mary Dougherty alias Quay of the Town of Peel of the one part and Henry Graves of the said Town, Shopkeeper of the other part this 11th day of Augst 1783 as follow .

First the said Mary Dougherty als Quay for & in consideration of the covenants, conditions & agreements herein after mentioned to be done & performed by the said Henry Graves his heirs, Exors Admrs & assigns have given granted and confirmed passed over & sold and by these presents doth give grant & confirm pass over and for ever absolutely sell from me the said Mary Daugherty my heirs exors, admrs & assigns all & singular a certain small dwelling house situated in the sd town adjoining to the public street that leads from the market place towards K.K.Patrick on the east to the church yard on the west to rent of the said Henry Graves on the north & to the rent of Wm Corran & Wm Clague on the south. To have and to hold unto him the said Henry Graves his heirs Exors Admrs & Assigns the premises aforesaid with all ways, waters water courses Easemnts Liberties, Lanes, Lights, passages and other appurtenances to the said premises belonging or appertaining from the day of the date of these presents.

Secondly.

The said Henry Graves in consideration of the before written article doth hereby for himself his heirs Exors Admrs & Assigns promise and engage that he will at his own proper [] & expenses rebuild the before mentioned small dwelling house which is at present in a tottering condition and after the house shall be so rebuilt that he will allow a decent room unto her the said Mary Dougherty and also unto Catharine Quay her sister to reside therein during their lives and the life of the longer living of them free and clear of any incumbrance whatever

Thirdly & Lastly

For the true and faithful performance of all & singular the within and before written Deed of Agreement and sale both parties have bound and obliged themselves their heirs Exors Admrs in the penal sum of twenty pounds British to be levied and paid according to law. In testimony whereof they have subscribed their names or affixed their marks the day & year first above written

Mary Dougherty married Thomas Witham. tobacconist. He had a public house licence from some time after 1781 until his death in 1789, after which his widow continued to hold a licence until c.1803, she died 1809.
