Re: Access to FHS Journals
In Response To: Re: Access to FHS Journals ()

re copyright then I must admit it was arranged in my early days of setting up a web site and I assumed that as I had permission (in exchange for the index) that the arrangement with the journal was the same as I was used to in academia that whilst the official copyright had passed to the journal (thus they could republish it in collections etc) there was a right returned to the author for publication on their website, university departmental collected papers etc (this is somewhat simplifying a situation that I have found is totally confusing to most librarians (and Manx law is subtly different from English law) but am willing to bow down before a lawyer (though reserve the right to quote Bishop Wilson's opinion of that profession)) - this is easily achieved in future by putting a clause in the journal saying that acceptance of this is a condition of publication (without it I suspect even reprinting the back issues, as was done, needs a seperate copyright clearance as it is a new publication). Those few authors who contacted me have thanked me for the greater penetration and responses generated but now of course many are dead (Rex Kissack wrote many of the early articles and it seems kept the journal going in its formative years though I recall a even more youthful Nigel Crowe also wrote several )

The Journal must also check copyright too as in the past it reprinted material that I think was still in copyright - but this whole area is a minefield similar to Intellectual Property Rights that could easily take more time off university researchers than doing the actual research - (lawyers are IMO a significant parasitical influence on society contributing little or nothing to the common good as compared to the costs extracted)

If the decision is based on personal differences then I'm happy to see them available elsewhere though obviously my offer to provide an index no longer stands.

My own suggestion is to republish only the articles/editorials and not the wants section - for that you must subscribe, together with a 3 to 5 years delay before appearance on the web (with possibly the option to the authors to reserve copyright)
