The Humble Petition if Ernest Gilmour Harvey of Newcastle on Tyne Solicitor

Sheweth

Sarah Georgina Bennett of No 33 Brook Street Bampton in the County of Devon died on the 13th day of March 1913 possessed of personal estate in the Isle of Man

The said Sarah Georgina Bennett left her last Will and Testament bearing date the 9th day of December 1911 probate whereof was granted from the Principal Probate Registry to your Petitioner on the 12th day of April 1913

It is necessary that Probate of the said Will be granted to some fit and proper person in the Isle of Man

Wherefore your Petitioner humbly prays a hearing hereof and that

your Honour may be pleased to grant probate of the said Will to your Petitioner or some other fit and proper person together with such other and further relief as is meet and your Petitioner will ever pray etc. etc.

I Ernest Gilmour Harvey of 15 Eldon Square in the City and County of Newcastle on Tyne Solicitor do make oath and say that I believe the paper writing hereunto annexed and marked with the letter A to be an exemplification of the last Will and Testament of Sarah Georgina Bennett late of 33 Brook Street Bampton in the County of Devon formerly of Willaston Douglas in the Isle of Man Spinster deceased who died on the 13th day of March 1913 at Highfield House Ilfracombe in the County of Devon that I am the sole Executor named in the said Will that I shall and will well and truly administer the personal Estate of the said Sarah Georgina Bennett deceased within the Isle of Man in terms of her said Will by paying her debts and the legacies contained in her said Will and distributing the residue of her Estate according to Law and that I shall and will return into the Registry if the above named Court a full true and perfect inventory of all and singular in the said Estate and render a just and true account of my administration thereof when thereunto required by Law so to do and further that the whole if the personal Estate and Effects of the said Sarah Georgina Bennett deceased within the Isle of Man does not amount in value to the sum if Four hundred and Fifty pounds sterling to the best of my knowledge information and belief

Know all men by these presents that we Ernest Gilmour Harvey of Newcastle on Tyne Solicitor William Thomson of Douglas Auctioneer and William Godfrey Cubbon of Douglas aforesaid are jointly and severally and any two of us bound unto our Sovereign Lord the King in the sum of four hundred and twenty pounds to the payment whereof well and truly to be made to our said Lord the king, his heirs and succcessors, we bind and oblige ourselves jointly and severally, and any two of us jointly, our Executors and Adminstrators, firmly by these presents.

As witness our subscriptions the ……. day of ………. in the year of our Lord one thousand nine hundred and thirteen

THE CONDITION of our obligation is such, that if the above-named Ernest Gilmour Harvey (hereinafter called "the Executor" who seeks to obtain a grant of Probate of the last Will and Testament of Sarah Georgina Bennett late of no. 33 Brook Street Bampton in the County of Devon but now deceased, who died on or about the 13th day of March 1912, at Highfield House Ilfracombe in the said County do, when lawfully called on in that behalf, make or cause to be made a true and perfect inventory of all and singular the personal estate and effects of the said deceased, which have or shall come into his hands, possession, or knowledge, or into the hands of any other person for him and the same so made do exhibit, or cause to be exhibited, into the proper Registry in that behalf whenever required by law so to do: And the same personal estate and effects of the said deceased, which shall at any time come into the hands or possession of the Executor, or into the hands or possession of any other persons for him or which without default might have come into the hands or possession of the Executor, do well and truly administer according to law, that is to say, do pay the debts and liabilities of the said deceased so far as the said personal estate will extend and the law bind the Executor, then this obligation to be void and of no effect, or else to remain in full force and virtue.

This is the last Will and Testament of me Sarah Georgina Bennett late of Willaston Douglas Isle of Man Spinster hereby revoking all previous Wills and Testamentary Dispositions made by me heretofore at any time I appoint Ernest Gilmour Harvey of Newcastle on Tyne Solicitor to be my Executor and I give unto him the sum of Twenty five pounds if he shall prove my will and administer my estate I give to Agnes Olivia Willing the daughter of the late Reverend Theophilus Willing of North Hill Rectory Launceston Cornwall my bracelet with Onyx Stones my pearl Brooch (two rounds joined together) my Topaz Cross Brooch and my Carriage Clock and I direct my executor to have such Clock put into good working order should it be needed before delivery to her at the cost of my estate I give all my wearing apparel to my sister Anne Eliza Poole except such as in the opinion of my Executor she cannot wear in its then condition and I direct my executor to send all such excepted wearing apparel to the Rector for the time being of North Hill Launceston Cornwall for distribution among the poor of that parish I give all the rest of my jewellery trinkets goods chattels and personal effects to my nieces Ella Violet Harvey and Isoline Maud Lewis equally to be divided between them I give the following pecuniary legacies free of all duty thereon to my sister Ann Eliza Poole the sum of four hundred pounds To my friend Agnes Willing the widow of the said Reverend Theophilus Willing and her daughter Agnes Olivia Willing the sum of Fifty pounds each To Francis Moreton Willing son of the said Reverend Theophilus Willing the sum of Two hundred pounds If the said Francis Moreton Willing shall predecease me I direct that such sum of Two hundred pounds shall be paid to his mother and sister hereinbefore mentioned equally to be divided between them in lieu and place of the sums of Fifty pounds each hereinbefore given to them To my said nieces Ella Violet Harvey and Isoline Maud Lewis the sum of Fifty pounds each To my friend Edith Scott now of Titchfield Terrace Marldon Paignton the sum of Twenty five pounds To Margaret and Eliza Anne the two daughters of my fathers faithful old servant John Cretney the sum of Twenty five pounds equally to be divided between them To Theodore Annesley Voysey and George Cuming Annesley Voysey sons of the Reverend Annesley Voysey Vicar of Moreheath Devon the sum of Ten pounds each All the rest residue and remainder of my property of whatsoever kind and wheresoever situate I give to my said sister Anne Eliza Poole and my nieces Ella Violet Steavenson and the said Isoline Maud Lewis equally to be divided between them And I direct that in the event of any difference arising among the beneficiaries hereinbefore mentioned as to division of the portions of my estate so given to them as aforesaid the decision of my executor shall be final and binding upon all parties In witness whereof I have hereunto set my hand this ninth day of December one thousand nine hundred and eleven

In His Majestys High Court of Justice The Principal Probate Registry Be it known that Sarah Georgina Bennett of 33 Brook Street Bampton in the County of Devon formerly of Willaston Douglas in the Isle of Man Spinster died on the 13th day of March 1913 at Highfield House Ilfracombe in the County of Devon And Be It further known that at the date hereunder written the last Will and Testament a copy whereof is hereunto annexed of the said deceased was proved and registered in the Principal Probate Registry of His Majestys High Court of Justice and that Administration of all the estate which by law devolves to and vests in the personal representative of the said deceased was granted by the aforesaid Court to Ernest Gilmour Harvey the sole executor named in the said Will And it is hereby certified that an Affidavit for Inland Revenue has been delivered wherein it is shewn that the gross value of the said estate within the United Kingdom (exclusive of what the said deceased may have been possessed of or entitled to as a Trustee and not beneficially) amounts to £1177-19-1 And it is further certified that it appears by a receipt signed by an Inland Revenue Officer on the said affidavit that £45-19-5 on account of estate duty and interest on such duty has been paid.

It appearing that the foregoing is an authentic copy of the last Will and Testament of Sarah Georgina Bennett late of no. 33 Brook Street Bampton in the County of Devon and formerly of Willaston Douglas in the Isle of Man Spinster deceased who died on the 13th day of March 1913 at Highfield House Ilfracombe in the County of Devon and that such Will was duly proved and deposited at the Principal Probate Registry of His Majestys High Court of Justice in England on the 12th day of April 1913 and probate thereof granted to Ernest Gilmour Harvey the sole Executor named in the said Will

The said Ernest Gilmour Harvey is sworn well and truly to fulfil and execute the said Will within this Isle and to administer the personal Estate of Effects of the said Sarah Georgina Bennett deceased within this Isle according to Law

I, Ernest Gilmour Harvey of 15 Eldon Square in the City and County of Newcastle-on-Tyne Solicitor, Executor of the above named deceadant being sworn on the Holy Evangelists make oath and say as follows:-

  1. I was well-acquainted with the said Testatrix Sarah Georgina Bennett
  2. The said Testatrix was never married and both her parents predeceased her
  3. The said Testatrix left the following sister and issue of a deceased sister her surviving namely: her sister Anne Eliza Poole the wife of Thomas Poole late of Crosby Douglas but now of Peveril Road, Peel, Isle of Man Gentleman and Ella Violet Harvey my Wife and Isoline Maud Lewis the wife of Wilfrid Lewis formerly of Lee Park Blackheath London but now of Park Langley Beckenham in the County of Kent Civil Engineer the said Ella Violet Harvey and Isoline Maud Lewis being the daughters of the Testatrix’s late sister Ella Steavenson who married David Fenwick Steavenson a Retired Judge of His Majesty’s County Courts and now residing at St. Ives in Cornwall
  4. The value of the personal estate in the Isle of Man is under £450

In witness whereof I have hereunto subscribed my name this fourth day of June one thousand nine hundred and thirteen

Ernest Gilmour Harvey is a son of Herbert Crammer Harvery eldest son of Rev Gilmour Harvey onetime master of King William's College (HC according to 1881 census born Douglas but baptised at Malew, a bright boy head of school and won a scholarship to Trinity Col Camb) - my own guess is to where Ernest met his future wife is that his spinster aunts following their father's death (who I think did not leave them much) ran a private ladies school - Claremont - in Ramsey - his grandfather was briefly vicar of Maughold for a year or so (before that vicar of Santan - and before that 3rd master at KWC and also curate of Malew).
