Archideaconal Wills Thomas Kerruish - #76 Ramsey, 1862

WHEREAS, the Ecclesiastical Court of the Isle and Diocese of Sodor and Man hath this day
granted Administration of all and Singular the personal  Estate
and effects of Thomas Kerruish of Maughold decd. with his
Trust Deed annexed to Robert Kerruish the Trustee
therein named _ __
And whereas William Kerrush of Booiley velt 
in the parish of Maughold and William Kinnish
of the Corrany in the parish of Maughold
have agreed to become Pledges for the due and faithful Administration of the said Estate by the said
Robert Kerruish according to Law.

NOW KNOW all men by these Presents, that we, the said William
Kerruish and  William Kinnish
hereby bind and oblige ourselves jointly and severally, and our Heirs, Executors and Administrators,
firmly by these presents, as pledges for the said Robert Kerruish that we
shall well and truly administer all and singular, the Personal Estate and Effects of the said
deceased according to Law.  And in his default we bind ourselves, and each of us for
the whole , our Heirs, Executors, and Administrators to be answerable and responsible to the said
Court, and to all parties interested in the said estate and effects, or the administration thereof in
the place and stead of the said Robert Kerruish

         Witness our subscriptions, this 23rd day of May in year of our Lord,
One Thousand Eight Hundred and Sixty Two

The foregoing Bond and Obligation was duly signed and delivered,
and also acknowledged by the executing parties to be their proper
Act and Deed

     This Indenture made this seventeenth day of January
One Thousand Eight hundred and Sixty two By and
Between Thomas Kerruish of the Town of Ramsey Grocer of
the one part and his brother Robert Kerruish of
Ballafayle in the parish of Maughold of the other
part

Whereas the aforesaid Thomas Kerruish carrying on
Business as Grocer and general dealer in the premises now
occupied by him near the Market Place in the aforesd. Town
is in declining health, and is desirous of providing
for the settlement and closing up of his affairs, and
providing for the discharge of his debts and liabilites 
in case of death __ Now this Indenture Witnesseth
that the [sd.] Thomas Kerruish, in consideration of [the Issues]
and Confidence he hath, and doth [Repose] with the sd. Robert
Kerruish and of the sum of five shillings to him the
sd. Thomas Kerruish paid by his said Brother, Robert
and in consideration of the uses and Trusts herein
after mentioned, Doth Give Grant pass over and sell
to the sd. Robert Kerruish, Att and singular his the
sd. Thomas Kerruishs Stock in Trade, now in his shop
or upon the premises occupied by him in the Town
of Ramsey aforesd. whether Connected with the
Grocery business, Baking business, or business of any
other Nature or description, Book debts, Notes Bonds or
obligations for the payment of money, In Trust nevertheless
that he the sd. Robert Kerruish shall permit and allow
the sd. Thomas Kerruish to have hold, manage and Transact
the sd. Stock and Trade and Business at all times during
the term of his Natural life; And upon the further Trust
that in the event of the decease of the sd. Thomas Kerruish
that he the sd. Robert Kerruish, shall take, have, hold
and stand seized and possessed of the whole of the sd.
Stock in Trade, Book debts Notes Bonds, and obligations
for payment of money for the purpose of paying and
discharging all and every the debts and demands
owed by and outstanding against the sd. Thomas
Kerruish at the time of his decease, and after paying
and discharging all the debts, Claims and demands
justly chargeable,due and owing by the sd. Thomas Kerruish
at the time of his decease together with funeral Expenses
and all charges and expenses in respect of the sd. Trust
In Trust to pay over the surpless if any to Margaret
Kerruish the Mother of the said Robert Kerruish and
Thomas Kerruish, whose Recept alone shall be a sufficient
discharge to him the sd. Robert Kerruish for such surplus
with out his being in any way accountable for the
after application thereof,
       Provided always, that so long as the said Margaret
Kerruish, by and with the assistance of James Kerruish and
[Catharine] Kerruish her Children  Carries on and Manages the business
(in order to turn the Stock in Trade at the time of the decease
of the sd. Thomas Kerruish to the best advantage) to the
entire satisfaction of the sd. Robert Kerruish, and that
the money from time to time received shall be paid
into the hands of the sd. Robert Kerruish, or otherwise be
applied and paid in discharge of the outstanding debts
by the sd. Robert Kerruish's order, that in case it shall
be [optineal] with the sd. Robert Kerruish, to allow the business
to be carried on until such Stock in Trade be disposed
of or otherwise, And also provided that the sd. Robert
Kerruish his Exor's. or Adminrs. shall in no case be
Accountable for involuntary or [insavoirable] loss,
Connected with the sd. Estate, but such loss only as may
be caused by his own Neglect or [Connivannce] __
      In Witness where of the sd. Thomas Kerruish [did] the
sd. Robert Kerruish as a consentrey party hereto [subscribed]
their Names to these presents this 7th day of January 1862.

                                                                  At a Chapter Court held in Ramsey on the 23rd 
                                                                    day of May 1862.

John Corlett and William M. Fletcher the subsscribed witnesses to the foregoing 
paper writing purporting to be a disposition of the Personal Estate and Effects
of Thomas Kerruish the Grantor having made Oath upon the Holy Evangelists
that said Thomas Kerruish, now deceases, when of sound and disposing mind
Memory and understanding duly signed and executed the same as and for
his proper act and deed in their presence. The same is therefore accepted by
this Court as and for the last Will and Testament of said deceased. And
Administration of all and singular the personal estate and effects of the
said deceased with the said paper writing annexed is granted and
Committed unto Robert Kerruish the Grantee and Trustee therein named
And he is therefore sworn to perform the said paper writing in accordance
with the intentions of the deceased  And to administer all and singular  the
personal estate and effects of the said deceased according to Law by paying
the just debts and funeral expenses of the deceased and the Legacies contained
in said paper writing annexed so far forth as the same will thereto extend
And the Law bind him And to return into the Archdeacon's Registry a full
true and perfect Inventory of all and singular said estate and effects
with an accurate account of his Administration thereof when thereunto
lawfully required  And to these ends he hath given pledges namely
William Kerruish and William Kennish both of the parish of Kirk
Maughold who have entered into  And executed the usual bond in
presence of the Court. __
