The humble petition of Philip Skillicorn of KK Lonan sheweth that Thomas Quayle
of Ballagare late deceased did by deed dated the 2nd day of August
1788 for certain good consideration therein mentioned grant unto you petitioner
all his goods and effects whatsoever as by the said deed may more fully appear;
that upon the death of the said Thomas Quayle your petitioner preferred his
petition to your Reverence praying that the said deed might be received and
as for the last will and testament of the said Thomas Quayle and your petitioner
might be sworn the executor or administrator as usual in such case; that William
Crebbin of the town of Douglas, merchant, did on or about the same time preferred
a petition to your Reverence praying that a paper writing purporting to be a
will alleged to be made by the said Thomas Quayle, might be proved and the execution
that committed to him the said Wm Crebbin; That the said several petitioners
came on to be hear before your Reverence at one and the same together, when
your Reverence xxx to continue, the said petitioner died, and no further proceeding
hath been had upon the petition; that the said William Crebbin hath lately departed
this life and no legal representative of him the said Wm Crebbin hath been constituted
or appointed by reason whereof your petitioner is prevented from proceeding
to bring the matters of the said petition to a final determination to the great
loss and detriment of your petitioner as he conceives a considerable part of
the goods and effects which were of the said Thomas Quayle being in a perishable
and hazardous state. And your petitioner therefore humbly prays for a hearing
of this petition, and that the last will and testament of Mr. William Crebbin
(if any there be) may be xxx in and proved. And if there be no such will, that
the next of kin of the said Wm Crebbin may xxx out letters of xxx his effects.
And in case of the declining so to do, that some other proper person or persons
may be appointed to administrate the same. And that you petitioner may obtain
