In the name of God, Amen. I Daniel Lace of Ballavoddan, one of the Deemsters of this Isle, being of sound mind and memory (thanks be to God for the same) but calling to mind the uncertainty of this mortal life, do therefore make this my last will and testament in manner following: First, I commit my soul to God, and my body to Christian burial. Secondly I leave and bequeath to each and every of my children hereafter named, vizt., Jane, Catharine, Esther, Mary, Christian & Alice, the sum of one hundred & twenty pounds apiece, the said sum of one hundred & twenty pounds apiece being by me now meant and intended to be the same legacy & legacies which was left and bequeathed unto them severally and respectively by me and my late dear and loving wife Jane Lace, otherwise Christian, in and by our joint last will and testament by us made and bearing the date the 19th January 1762, and in which said legacy of one hundred and twenty pounds apiece now by me left and bequeathed unto them in this my last will and testament the former joint legacy left and bequeathed unto each and every of them as will on my part as on the past of their said late dear deceased mother is to be comprehended and included; provided nevertheless, and it is my will and desire, that each and every of my said children shall not receive this said several and respective legacies, until they shall severally arise to the age of twenty one years, or until they shall be severally disposed of in marriage, excepting the sum of five pounds which is to be paid unto each and every of them out of their said several and respective legacies immediately after my decease. And it is also my further will and desire, and I do hereby accordingly direct and appoint that if any of my before named children shall die before the arrived age of twenty one years, or before she be disposed of in marriage, that then such child or childrens legacy or legacies shall fall and become due to my executrix hereafter named. And I do also hereby direct and appoint that as the several and respective legacies left and bequeathed unto my before named children are to be and remain in manner as before mentioned in the custody of my executrix hereafter named, that she my said executrix is to supply my said children with all proper necessaries and maintenance, as also to have them daily and properly educated. Also, I leave and bequeath to the Revd. Daniel Gelling my daughter Elizabeth his wife the sum of twenty pounds, which is also to be understood to be and meant and taken to be the same legacy of twenty pounds, which was left and bequeathed unto them by the joint will and testament of me and my late dear deceased wife. Also I leave bequeath and devise unto my eldest daughter Anne, or to womsoever of my children my said estates of Ballavoddan etc. shall descend as inheritance all and every that or those small parcels of intacks lately purchased by me and my late dear deceased wife from Daniel Kaneen, William Lace & John Garret, and the same to pass and descend hereafter as heirship or lands of inheritance. Lastly, I nominate and appoint my loving daughter Ann Lace my true and lawful executrix of this my last will and testament as also residuary legatee of all my other worldly goods and effects moveable and immovable whatsoever and I do also hereby appoint my said loving daughter Anne and my three brothers John, Charles & William Lace guardians of my said children by and with the advice and under the direction of my very good friends Daniel Mylrea Esquire, Receiver General, the Revd. William Mylrea Archdeacon, and the Revd. James Wilks or any two of them. In testimony whereof I have hereunto subscribed my name this 30th April 1762. [signed] Dan Lace. The petition of Ann Lace of the parish of Andreas sheweth: that the worshipful Daniel Lace one of the Deemsters of this Isle your Petitioners father departed this life on or about the 24th March last, but previous to his death when of sound and disposing mind and memory he made and published his last will and testament in writing in presence of credible witnesses, and thereby appointed you Petitioner residuary legatee and sole executrix of his said will; that there are several conclusive motives inducing your Petitioner to have said will authenticated particularly several matters of account depending between said deceased and other persons, some of whom intend shortly to depart this Isle as Petitioner is informed, and more especially as Petitioner is well advised she can do no legal act as representative of the deceased until she is first qualified according to law. She therefore prays you would be pleased to appoint a short day for te probate of sail will and that you would give such necessary directions therein as you shall think advisable and Petitioner as bound shall ever pray &c.
I appoint this matter to come on at a Consistory Court to be holden at Ballaugh on Friday next, and hereof all proper parties & persons to have due notice & service. Given this 12th April 1768.
By virtue of the Revd. Vicar Genl. Curghey his order granted upon the petition of Ann Lace, I have given due and timely notice to Charles Lace, William Lace, to the Revd Daniel Gellin & wife Jane Lace & Cathrine Lace all of them to appear before his Reverence at Ballaugh on Friday next by ten of the clock in the forenoon to answer the suit of Ann Lace as witness my subscription on this 13th April 1768, [signed] John Radcliffe Sumner of KK Andreas.
At KK Andreas, August 1st 1771, at the request of the Revd. Wm Mylrea Archdeacon one of the pledges within named, Wm Cubbon husband of the executrix has now given courter[?] security for the due fulfilling of the last will of her testater Daniel Lace one of the Deemsters of this Isle, namely Wm Christian of Ballayonnaag in the Parish of KK Bride who hath become pledge for him in for of law of the indemnity of said former pledge. At a Consistory Court holden at Ballaugh 15th April 1768, The Revd. William Mylrea Archdeacon & the Revd John Gill Vicar of KK Christ Lezayre two of the subscribing witnesses to the before written last will and testament of Mr. Daniel Lace late one of the Deemsters of this Isle deceased (the other subscribing witness to said will, vizt. William Crye being since dead) have deposed on the holy Evangelists, that the before written will was duly signed, published and declared by the said late Mr. Daniel Lace as and/or his last will and testament in the presence of them the said two subscribing witnesses who have been now sworn, as also in the presence of the said Wm Crye the other subscribing witness thereunto, who is since dead. Whereupon Mrs. Anne Lace eldest daughter of the said testatrix Mr. Daniel Lace deceased together with Charles Lace, John Lace & William Lace brothers of the said Mr. Daniel Lace are sworn guardians of the children that are under age pursuant to the said will, and the said Mrs. Anne Lace is also sworn executrix in Court in form of law, and hath given pledges for the payment of debts and legacies, namely the Revd Mr. William Mylrea Archdeacon & the Revd John Gill Vicar of Lezayre the witnesses of the will. The executrix hath likewise given her consent in Court to take upon her the maintenance of education of the children that are under age, pursuant to the will, & the same is accordingly committed unto her together with their goods. We Jane Lace and Catharine Lace daughters of the worshipful Daniel Lace one of the Deemsters of this Isle and of Jane Lace otherwise Christian, do hereby acknowledge this day to have received at and from the hands of William Cubbon our brother in law & Anne his wife, as assignment of a mortgage they are entitled unto for the principal sum of two hundred pounds, upon the lands of William Teare and Charlotte his wife as by deed bearing date August 7th, 1762, doth appear, as also the further sum of forty pounds in cash both which sums amounting to two hundred and forty pounds completes the legacy of one hundred and twenty pounds bequeathed unto each of every of us by the last wills and testaments of our said parents accorded in the Archdeaconry Registry, vizt., our said mothers will in Libra 2nd, 1762, and our said fathers will in libra 1st, 1768. And do hereby release acquit and discharge our said brother in law Wm Cubbon & Anne his wife their executors & administrators of the said legacies bequeathed unto us respectively. In witness whereof we have hereunto subscribed our names this 18th day of December 1770. [signed] Jane Lace, Catharine Lace. May 29th 1777, I Esther Lace one of the daughters of the worshipful Deemster Lace one of the Deemsters of this Isle and of Jane Lace als Christian, do hereby acknowledge to have this day received and from the hands of William Cubbon our brother in law & Ann his wife the sum one hundred and twenty pounds, the same being a legacy bequeathed unto me by the wills of my said parents. And I do hereby release requit and discharge my said brother in law Wm Cubbon & Ann his wife their executors, administrators & assigns of the said legacy bequeathed unto my by the wills of fore said parents. In witness whereof I have hereunto subscribed my name this 29th May 1777. [signed] Esther Lace.
Whereas Daniel Lace of Ballavoddan Esquire, one of the Deemsters of this Isle, late deceased, in and by his last will and testament in writing and bearing dath the thirtieth day of April in the year of our Lord one thousand seven hundred and sixty two did (amongst other legacies and bequests therein contained) give leave and bequeath unto us the Revd. Daniel Gelling & Elizabeth Gelling als Lace (his son in law) and daughter the sum of twenty pounds which is to be understood to be meant and taken to be the same legacy of twenty pounds, which was left and bequeathed unto us by the joint last will and testament of our said late deceased father & mother (and the said Daniel Lace by his said last will & testament made constituted & appointed his loving daughter Anne Lace (who has since intermarried with Wm Cubbon) whole and sole executrix thereof. Now know all men by those present that we the said Daniel Gelling and Elizabeth Gelling my wife aforesaid do hereby confess and acknowledge that we have had and received of and from the said William Cubbon & Ann his wife the said legacy or sum of twenty pounds, to us given and bequeathed by the said Daniel Lace and therefore we do by these present acquit release and discharge the said William Cubbon & Ann his wife of and from all legacies dues duties and demands whatsoever which we or our executors or administrators may have claim challenge or demand of or against them or either of them, by virtue of the last will and testament of the said Daniel Lace our late deceased father. In witness whereof we have hereunto subscribed our names this 20th day of August 1768. [signed] Daniel Lace.
I Jane Lace granddaughter of Mr. William Christian of Ballamoar in the Parish of Jurby and Anne Christian als Mcylrea, do hereby acknowledge to have received from my brother William Cubbon U sister Ann Cubbon als Lace the sum of one guinea in full of the legacy devised unto me by my said grandfather & grandmother (they being xxx thereunto) and do hereby acquit and discharge my said brother and sister their executors and administrators of the same. I Catharine Lace granddaughter of the said William Christian do also acknowledge to have received from the aforesaid Wm Cubbon & Anne his wife my brother and sister the sum of half a guinea bequeathed unto me by my said grandfather (my foresaid grandmother being dead some years before I was born) and do hereby discharge my said brother and sister their executors and administrators of the same. I Alice Lace daughter of the worshipful Daniel Lace one of the Deemsters of this Isle and of Jane Lace otherwise Christian do hereby acknowledge to have received at and from the hands of William Cubbon my brother in law and Ann his wife, by the hands of John Lace Esquire, the sum of one hundred and twenty pounds the said sum being in full of a legacy of one hundred and twenty pounds bequeathed unto me by the last wills and testaments of my said parents, and I do hereby release acquit and discharge my said brother in law Wm Cubbon & Anne his wife their executors & administrators of the said legacy bequeathed me. In witness whereof I have hereunto subscribed my name this 6th day of August 1782. [signed] Ealy Lace.
Whereas Daniel Lace of Ballavoddan Esquire, one of his Majestys Deemsters of this Isle deceased in and by his last will and testament in writing bearing date the thirtieth day of April in the year of our Lord 1762 (amongst other legacies & bequests) devise unto his daughter Christian Lace the sum of one hundred and twenty pounds which legacy is to be understood to be meant and taken to be the same legacy of one hundred and twenty pounds which was left and bequeathed unto her by the last will and testament of her deceased father and mother, and the said Daniel Lace the survivor having by his last will and testament made constituted and appointed his loving daughter Ann Lace (since intermarried with William Cubbon) whole and sole executrix of such his will; now know all men by these present that I the said Christian Lace now arrived at the age of twenty one years, do hereby confess and acknowledge to have had and received of and from the said William Cubbon the said Legacy or sum of one hundred and twenty pounds Manks to me bequeathed by the said Daniel Lace and Jane Lace my father and mother aforesaid and therefore do by these presents acquit release and discharge the said William Cubbon & Ann his wife his or her heirs, executors, administrators and assigns of and from all legacies dues duties and demands whatsoever which I or my executors administrators or assigns may have claim challenge or demand of or against them or either of them, by virtue of the said will or wills of my said deceased father or mother.
