Children of Wm Ellison & Cath Ellison als Norris deceased 1689 - no account for 20 years presumed dead;Wm Ellison together with John & Margt Cottier children of his sister Alice (Alice died about 8 years ago) petition for administrion;counter petition by William Ellison of Kk Patrick with led to court case to determine parentage. Presume the need for administration arose from death of Sylvester Ellison in 1761.
The assumption must be that the records of Kk German for this period were already missing as otherwise any second wife would be easily proved by recourse to them.
April 10th 1764 between Wm Ellison pltf & Math Shimin & Richd Ellison defts William Cooile of Peeltown aged about seventy four years or there [abouts] produced & sworn in behalf of the Defendts deposith & saith he was ^in the time of his youth & for several years after till the time of their death^ well acquainted wth Richd Ellison of the Claddagh near Peelto[wn] and with Henry Ellison who dwelt in an house near the market place of sd town & was a weaver by trade - saith that the said Richd & Henry Ellison were generally esteemed & reputed & that the depont himself looked on sd persons as lawful brothers, and that he never till this day in court heard it sayd that they h[ad] different mothers - saith that the sd Richd was generally esteemed & the deponent believes was the eldest brother, & th[at] he mostly passed by the name of the heir of the claddagh which claddagh is now held & possessed by Richard Ellison grand[son] of foresd Richd Ellison - saith that if the sd Richd & Henry Ellison would have had different mothers, he would have heard thereof sometime before this day disputed in court - saith that sd Richd Ellison first named had three children namely Silvester Ellison father to Richd Ellison one of the defts and Ellinr Ellison who went abroad & was married in the city of Dublin as Depont has heard & believes, and another daughter named Margt who was mother to Matth: Shimin one of the defts Being cross examined in behalf of the plaintiff deposeth & saith he did not hear that the sd Richd & Henry Ellison were sons of Cath Norris in regard the sd Cath Norris was dead before his time. Being asked whether he heard anything to the contrary that Wm Ellison father of the above mentioned brothers Richd & Henry Ellison had been married to another wife before he was married to Cath Norris - the depont answereth & saith he never did Wm Cooile his mark William Cooper of Kk German aged fifty nine years or thereabouts produced and sworn on behalf of the defendts disposeth & saith that he hath often heard of Wm Cooper his grandfather who was aged seventy four or seventy five years of age at the time of his death & who died about forty years ago - as also by Wm Cooper his father who died about three years ago, aged seventy seven years or there about & likewise by Gilbert Comish who died about twelve or thirteen years ago aged above seventy years as deponent believes in like manner by Wm Caine who died ten or twelve years ago & an old man - that Richd Ellison & Henry Ellison sons of Wm Ellison were brothers by father & mother (in manks Doonaghyn dooie) & that sd Richard Ellison was the eldest brother & heir of the Claddagh, & that sd Henry was a weaver - saith he also heard by the foresd persons, that sd Richard Ellison had three children namely Sillvester Ellison father of Richd Ellison one of the defts in this cause and Margt Ellison mother of Matth Shimin the other deft and likewise another daughter of whose name depont does not recollect who left the Isle & moved to Ireland on account of Wm Fairbrother who courted her & proved false to her as depont hath heard. Being cross examined in behalf of the Pltf & asked whether he heard by this grandfather, father & other authorities mentioned any thing sayd of Cath Norris wife of Wm Ellison answereth & saith he cant say he did or did not. Being asked what age he was when his grandfather gave him the above acct, answereth & saith he believes he might be about twelve years or [iyiwas ?] & does not know whether he might not have been sixteen or seventeen years of age at the time. Wm Cooper John Comish of Peeltown, aged sixty five years or there about produced & sworn in behalf of the defendts deposeth & saith he hath often heard his father Gilbt Comish who died twelve years ago or there abouts aged seventy two years or there abouts, as also by Wm Caine who died about ten or twelve years ago aged seventy years or there abouts say Richd Ellison & Henry Ellison were brothers & sons of Wm Ellison, but did not hear them say anything of the mother of sd Richard & Henry Ellison, & that he did not hear them say that sd Wm Ellison was married to two different wives & saith has hath heard his sd father & Wm Caine say that Richd Ellison was the eldest brother & heir of the Claddaugh, & that Henry was bred a weaver John Comish his mk William Ellison Plaintiff in this cause aged sixty two years or thereabouts being sworn by consent of the defendts declareth & saith his father Henry Ellison died when he the declart was about four years of age that he well remembers his own mother, Ann Ellison als Bodaugh, who often told this declarant he had an uncle called Richd Ellison but did not tell him whether the sd Richd Ellison & Henry Ellison were full brothers by the same father and mother or not, nor does he the declart know whether they were or were not; and that his sd mother never told him that Wm Ellison's father of the sd Richd & Henry Ellision were marrried to any other woman than Cath Norris William Ellison
