The last will and testament of Cathrine Woods als Lace of Peeltown wife of Hugh Woods of said town, being of sound mind and perfect memory at uttering these following words about the first of January 1763 or thereabouts who departed this life 15th of said month First she committed her soul unto Almighty God and her body to the earth and christian burrial. Item she bequeathed and devised unto her daughter Leonora woods six pence legacy Item she bequeathed and devised unto her son John Woods her mother's chest as legacy Item she bequeathed and devised unto what was on her bearing two shillings legacy and unto her godson in Kk Andrews seven pence if her executor think proper to give it And lastly she nominated and appointed her dear and loving husband Hugh Woods whole and sole executor of all the rest of her effects moveable & immoveable of what kind or nature soever and her said husband to have the tuition and maintenance of her children for if Danold come among you he will strip you and devide the bill that goes into your mouths, excluding all other craving friends and relations with six pence legacy each. In witness whereof we have subscribed our names and marks this 19th January 1763 Witnesses present Thomas Cannell my mk X Robert Clark his X At a court of Correction holden at Balnyhown Feb 23 1763 Some objections having been made to the validity of the above will by Daniel Lace brother of the decd alledging the same was extracted thro' force & ill treatmt & in support of his allegation produced Ellr Brew as evidence who being sworn & examined deponeth & saith she was by & present when the above named Cath Woods disclosed her will to the purposes aforesd save that she the sd Cath did not commit her soul to God & body to christian burial & that she does not remember the sd Cath bequeathed two shillings to the child then on her bearing. - saith that after the sd will was made in manner aforesd & that the witnesses with Hugh Woods husband of sd Cath had left the room where sd Cath lay sick the sd Cath Woods & the dpnth being only in the room, the sd Cath addressed the dept in the following words Christ look upon me, he's against my mind & will I have done (meaning her will) as I have done for it was on acct of getting something (meaning sustenance as dept understood) I have done it The dept then told the sd Cath you have surely done wrong in not leaving your cloaths at least to your daughter, whereupon the sd Cath replyed Christ look upon me, there is much unknown to you, for I was obliged to lie in the outhouse the first unkind snowy night of the snowy weather in my shift & little petticoat on this account in the condition I was in (meaning her will the dept understood - saith that she the dept observed the sd Cath there were a great many debts & that sd Cath replyed Christ look upon you - there are but there are also a great deal of houses & lands all of which came by me Ellr Brew her mark X Thos Cannell & Ro Clark witnesses of the foregoing alledged will being sworn & examined in behalf of Hugh Woods depose & say that Cath Woods the alledged testatr being of perfect mind & memory declared in manner within written, save that she did not commit her soul to God & body to the earth & christian burial - say they saw no force or ill treatment made use of in their presence - say that at the time of making the sd will Hugh Woods the sd Cath's husband say'd to his wife if I was making my will I would have Len (meaning his daughter Leonora as depts apprehended) ten pounds upon which sd Cath say'd do as you will - say they know of no other will made to the contrary Thos Cannell his mark Ro Clark his mark taken before us Ro Radcliffe Matths Curghey At a court of correction holden at Balnyhown Feb 17 1764 [?year as very dark] Daniel Lace uncle & next of kin to the children of the testr by the mother's side having made some objections agt the foregoing will which is proved in manner thereto annexed. For avoiding further litigation Leonora one of the children of the testatrix being arrived to lawful years has made choice of her uncle Danl Lace aforesd to be her guardian who is thereupon sworn guardian of her & John the youngest child in form of law, and he the sd Danl Lace by consent of the sd Leonora has agreed that the sd will do take place & be of full force on conditiuon that Hugh Woods the widower & excr named do pay unto the sd Leonora the sum of eight pounds within twelve months of the date hereof & deliver unto her immediately the whole of her mother's apparell and likewise on condition he pay unto his son John the sum of ten pounds when he arrives to lawfull years & undertake his tuition & maintenance until wch time: all which the sd Hugh Woods obliges himself to perform & fulfill whereupon he the sd Hugh Woods is sworn for payment of debts & legacies according to law & is to give pledges to the revd Vicar genll Radcliffe in a few days Probatum est cum consensu Ro Radcliffe Matths Curghey At Kk Patrick March 21 1764 Willm Quine of Kk Patrick & Henry Woods of Peeltown became pledges for Hugh Woods in form of law that he will fulfil the last will & testament of his decd wife as also the agreemt thereto annexed as also together the debts of the decd as far as the goods will extend & the law shall bind Ro Radcliffe
