Episcopal Wills 1743 German #3, of James Young

At a consistory court at Kk Michael []
Peeltown Feb 3 1743
James Young departed this life about
the first of August last past. Intestate
and whereas Margt his widow refuses to
administer the effects of the deceasd. And that
the children at age being charg'd before us
have not appeared to accept of the administration
The same is committed unto Mr Daniel 
Christian principal creditor who is sworn
to bring to the registry a perfect inventory
of the goods chattels & effects moveable
and immoveable And if need requires
to sell the same at publick cant for the
benefit of claimers to the best advantage
The surplusage after the paymmt of debts & charges
to be forthcoming for the children of the deceas'd
vizt James, George, John, Ann & Ellinor Young
Pledges in form of law are Wm Lace Vitchal &
John Brew Gilkath
The widow is sworn to enter a just account
of the goods to the administrator

We whose names are hereafter hereunto
subscribed being a jury of four men sworn by
vertue of the Revd Vicar Genl Moore's token to
estimate a value on the houses and land of James
Young of Peeltown late deceased and having viewed
the same, we do estimate or value the dwelling
house together with the brewhouse backside & garden
viz the deads part to fifteen pounds, the deads
of the barn we value to three pounds, the deads
part of the close, we value to twelve pound, the
deads part of a small croft near the mill, we value 
to ten shillings, the whole of the above sum being
thirty pounds ten shillings, and this we return
for our answer this the 8th of february 1743/4

till he pays the same with fee

At Kk Michael May 6 1745
James Young decd having in his contract bargain upon
certain considerations therein sett forth promised to pay
unto his fathr & mothr vizt to David Young & Margery his 
wife the sum of tenn pounds - with the further sum of 
ten pounds after the decease of the longer liver of his sd
parents - and for as much as no voucher appears, nor any
circumstances alleg'd for paymnt of any part of ye sd sums
and that sd Margery hath made oath that she never received
anything in lieu or in consideration thereof nor any othr to
her knowledge in her behalf Mr Danl Christian
the adminr in trust is hereby ordered to pay unto sd Margery the
deads part of the former ten pounds - vz to pounds tenn
shills - otherwise sd adminr is to be comtted till he submits & pays all fees

At Kk Michael May 6th 1745
It appearing by the contract bargain of James Young decd that
sd James for certain considerations therein mentioned, oblig'd
himself to pay unto his fathr David Young decd also the sum
of tenn pounds - with the further sum of tenn pounds after the
demise of ye longer liver of the sd David & Margery his wife
And whereas it does not appear that any part of ye sums
promis'd have been discharged and that Mrs Cath Callin als Young
one of the adminisrs of David Young hath
made oath that she has not received anything in consideration
of her share of ye sd sums - Mr Danl Christian the adminr 
of James Young is hereby ordered to pay unto Mr John Callin
in right of his wife Mrs Cath: Callin aforesd the sum of
one pound five shills on the deads part of the former
£10 so promised in contracr - otherwise sd adminr 
is to be comtted till he submits & pays all fees

Mr John Callin having also prov'd the sum of
six shills & the deads part thereof is also orderd to
be paid sub pana juris
Augt 1 1748 Mr John Callin acknowledged to
have rec'd from Mr Danl Christian adminr of
James Young the full contents of the within
orders vizt the deads part - before me Edw Moore

At Kk Michael May 6th 1745
Ellinor Young one of the adminrs of David Young having surrended
her right to the effects of the deceased to her mother Margery Young
it appears that the sum of £1 5 0 is due unto her as one of her fathrs
adminrs on the deads part by the contract bargain of James Young
deceased - ordered that  Mr Danl Christian administr in
trust of the goods of James Young do pay unto Margery
Young aforesd in the behalf of Ellinor the above sum of £1 5 0
being sd Elinor's share of the said ten pounds promised in the
contract bargain - viz the deads part of that sum, otherwise
sd Danl Christian is to be committ'd till he submits and pays
all fees
