Thos Kelly having entered claim agt the admr of his brother Capt Robt Kelly for sundry particulars to the balance of thirty pounds the matter was this day heard, when the claimr has proved the sum of fifteen shills & three pence to be due from the decd for goods had out of his shop as per bill, which sum he declares is the cash mentioned in his claim ; as to the other bill annexed the particulars whereof he alledges to be part of what fell to him as exr of his father & mother that the household goods were by him pledg'd to his sd brother for six guineas& the rest left in the estate - forasmuchas it appears by the inventory of all the effects of his sd father & mother decd 1724 brought in by vertue of his oath, that the household goods were sold to his brother & there is no mention in the sd inventory of any deal boards, goats, sheep or geese the other parts of his claim - we cannot admit of his demand further than the above sum of fifteen shills & three pence, the deads part whereof is hereby order'd to be paid by the admr sub pana confinemt in St German's prison until she pay the same wth all fees Dat ut sipra
