Articles of Marriage condiconed agreed and concluded [] betwixt Henry Waterson of Fisgard & Cescely his wife in [] behalf of their loving nephew Thomas Waterson on ye one p[arty] & Will: Kelly with ye consent of his wife Mally Kelly als G[] all of ye parish of KK Xt Rushin in ye behalf of their daughter Margrett Kelly on ye other party as follows Imprimis It is condescended agreed & concluded upon yt ye sd Thomas & Margt shall within three months after ye date hereof en[ter] into ye holy estate of matrimony God & holy church permitting ye same (2ly) It is condiconed agreed & concluded upon yt ye sd Wm Ke[lly] with ye consents aforesd shall give in portion to & with his sd dau[gh=] ter ye sume of three pounds sterl or ye value thereof together with his part of one steir? in ye keeping of ye sd Henery Waterson & wch three pounds are to be paid within ye end of three years after ye date hereof (3ly) It is condiconed agreed & concluded upon & in consideration yt his sd nephew doth hereby promise & shall give to him ye one ha[] of ye sd portion he likewise doth hereby give & shall deliver to his sd nephew & to ye above Margt his now intended wife ye one halfe of all his goods movable & immovable & this immediately after their intermarriage Nevertheless it is hereby condicon[ed] agreed condiconed & conclucded upon yt there shall be no actual division of the ye sd portion nor goods during ye sd Henry's or his wives lives but each vizt ye sd nephew & his wife with their children on ye one hand & ye sd Hen & his wife shall endeavor together participate together of both ye sd portion & goods during ye sd Henry & his sd wives lives as affsd unless there shall be an actual division made by ye consent of both parties (4ly) it's condiconed agreed & concluded upon yt in consideration ye sd nephew Thomas Waterson hath for many years been a great support [page 2 - top lh corner too dark on film]] [] uncle ? Hen: Waterson in his old age, he ye sd Hen: Waterson wth full consent of his wife affsd doth hereby promise to him ye sd nephew [] Waterson & ye sd Margt their heirs excrs admrs & assignes all ye [] of their goods movable & immovable after their decease vizt ye other halfe of ye uncles goods immediately after his death & ye other halfe of ye sd Cescely's goods after her death so yt its here to be understood yt after ye death of ye sd uncle & of his sd wife Cescely ye sd young cupple Thomas & Margt their heirs excrs admrs & assignes shall enjoy & possess all their goods movable & immovable except only 6d legacie to any of his next of kin who by law claime any of his exrship.
