Archdeacon Will 1716 #35 of Jane Kaighin als Cannell, Michael,

Deed made 10 April 1705, Will made 28 Feb 1711/12 & died 3 days later, Will proved 11 April 1715:

"Michael: To all people to whom present writing shall come, Know ye that I Jane Kaighen als Cannell of the parish of KK Michael as well for and in consideration of the natural affection and love which I have and do bear unto my well beloved son Charles Kaighen of the parish aforesaid as also for divers other good causes and considerations me at this present Especially moving have given and granted And by these presents do give grand and confirm unto the said Charles Kaighen all and singular my goods chattels leases ready money; plate, jewelry, rings, household stuff, utensils, brass, pewter, bedding, and all other my substance whatsoever, moveable and immoveable, quick and dead, of what kind nature quality or condition soever the same are or be and in what place or places, soever the same be shall or may be found, as well in mine own custody or possession as in the possession hands power and custody of any other person or persons whatsoever; (only reserving to myself to be at my own disposal a new fledge with a half worn fledge two new blankets my own wearing clothes both woolen and linen four pewter dishes with one flagon marked J:K To have and to hold all and singular the said goods, chattels, leases and all other the aforesaid premises unto the said Charles Kaighen his Executors Administrators and Assigns to his and their own proper uses and behoose[?]; for ever freely and quitly without any matter or challenge claim and demand of me the said Jane Kaighen als Cannell or of any other person or persons whatsoever for me in my name by my cause means or procurement and without any money or other thing therefore to be yielded paid or done unto me the said Jane Kaighen my Executors Administrators or assigns, and I the said Jane Kaighen all and singular the aforesaid goods chattels and premises to the said Charles Kaighen (except before excepted) And further know ye that I the said Jane Kaighen als Cannell have put the said Charles Kaighen in peaceable and quite possession of all the singular the aforesaid premises by the delivery unto him one coined piece of silver called seven pence and the said Charles Kaighen is to find his said mother Jane Kaighen with meat drink bedding and washing during her natural life such as is convenient and for the performance hereof both parties have bound themselves in the penalty and forfeiture of twenty pounds in nature of all fines within this Isle as witness the names and marks this 10th April 1705. 19th April 1705: Jane Kaighen als Cannell came this day and acknowledged the above Deed or Settlement to be her voluntary act and xxx before me, and also her son Charles is xxxx account, Dan: Mylrea.

KK Michael February the 28th 1711/12: This day being come to visit the said Jaine Kaighin als Cannell who was sick and weak in body, but of sound and perfect memory, she declared these words as her last Will and Testament fo what she had reserved unto herself out of the within Deed or Settlement. First she committed her soul into the hands of Almighty God and her body unto Christian burial. Item, she left and bequeathed unto her daughter Jony a piece of black prenalla for a suit of clothes for her. Item, she left unto her grandchildren John Leece’s children a white hood apiece and a black camlet petticoat bewixt them. Item, she left unto Christian Cannon als Cannell a sad color searge petticoat. Item, she nominated and appointed her loving son Charles Kaighin & his wife her true and lawful Executors of all the rest of her goods moveable and unmoveable whatsoever and the within Deed or Settlement to be of full force in form of Law before us. Witnesses: [signed his mark] Thomas Quayle, [signed] Henry Norris.

April the 11th 1715: We whose names ensue were this day present when Charles Kaighin asked his mother Jane Kaighin being three days before she died whether that will she made and declared before Mr Norris and Tho: Quayle was her last will and testament and the said Jaine Kaighin replied, that she allowed of that will and no other, all this is truth, as witness our names and mark the day and year above written. [signed their marks] John Mcylvorey, John Cannon, Mary Callister. The Executor sworn in Court in form of Law. Pledges to secure the office &c., Thomas Quayle & John Cannan.

Mary Courghan enters her claim against the Executor of Jane Kaighin for a candlestick worth 6 shillings & carves the Law. To the Revd Mr. William Walker Vicar General, the humble petition of Charles Kaighin, Shewing, that one William Cannan is witness to a deed that the said Charles Kaighin’s mother in her lifetime owned and acknowledged before the said Cannan, and another witness that she allowed of no other will or deed but what was made and passed before to her said son, And being the said William Cannan is now lying under God Almight hand, the said Charles craves and desires that power may be granted of the Rev. Mr. Norris take the said Cannan’s oath concerning the same being afraid that he may die of the sickness he is now in this granted he as bound shall pray.

Bishops Court, April 4th, 1716: The Revd. Mr. Norris is desired forthwith to take the Deposition of William Cannon in respect to his being in so infirm a condition, and to ratify the same under his hand, that it may be produced at the next Sheading Court, if the man himself be not able to appear.

March the 14th, 1716: According to the within direction, I went to the within William Cannon and read to him the words, that were certified by him and two other witnesses, that they heard pass between Charles Kaighin and his mother three days before her death, and the said William Cannon being then very sick and weak took his oath upon the Holy Evangelist that his old Mistress Charles Kaighin’s mother declared before him and his other fellow servants that the will she made before Mr. Norris and Thomas Quayle was her last Will and Testament and that that was the will she allowed of and stood to this attested by.
