12TH JANUARY 1709: PHILLIP CALLISTER and WM FLEXNEY the witnesses to the within writing have deposed the same to be the Act & Deed of the within WM QUALTROUGH and DOROTHY HIS WIFE, before me, Jon. Parre.
JANUARY 31ST 1709: XXXX KENLEY & WM KELLEY WITH HIS SON present heir of R--- KK Lonan being before me this day touching ye withing xxxxx surrender of half a quarter of land given by he xxxxxx & his WIFE to HER SON WILLM QUALTROUGH & HIS WIFE in Marriage Contract. It was proposed to ye sd WILLIAM xxxx xxxxx he rec'd let ye aforsd PHILIP KEWLEY xxxxx xxxxxxxxx Raby during his natural life; as he had it xxxxxx fore. To which WILLM KELLEY reply'd, He xxxxx ye half of that Estate, but would stand to xxxxxxxxx contraction and would refer ye difference xxxxxxxxx of the aforesd Deed and ye Contract of xxxxxxx determination of ye Law. Whereupon & at ye in------ of ye sd PHILIP KEWLEY and for ye better security of ye foresd Deed, having relation to some proceedings in ys Spiritual Court, the same is ordered to be recorded. "44, Lonan: Know all men by these presents that I WILLM QUALTROUGH of Rabey in the parish of KK Lonnan, in the Isl of Man, and DOROTHY QUALTROUGH ALIAS SHIMMIN MY WIFE di---- good causes and considerations us there unto m---ing But now especially out of the great love and tender affection we have the one to the other as man and wife and that it hath pleased God that there is no issue between us hitherto: Therefore for want of the foresd issue wee due freely for the avoiding of further trouble that might insue after the decease of either of us the above named WILLM OR DOROTHY MY WIFE make xxx the one to the other all and every such goods chattels and cattles as shall be in the possession of us: or any wise belonging or a----ing to us at the death of either of us that the survivor of us shall enjoy the whole effects that now is or shall at the decease of the formost of us be yn in our holding or any wayes due to us by virtue of this our deed of gift only the above WILLIAM and DOROTHY MY WIFE doe leave six pence apiece to any such of our Relations of either side as shall xxxxx make claime to any part of our effects, after the decease of either of us by consanguinity as legasie to cut them off from any further claime thereto: But if it shall please God that wee have issue between us after the signing sealing and delivery hererof that yn and in that case this deed is to be xxxx and of noe force but the issue to have and enjoy the effects of the first deceadent of either of us: further xxxxxx here should be among construction after the decease of either of xxx xxx to this our deed touching the cropp of corn, and teame xxxxx is therefore for the avoiding of any such samples[?] declared by both of us the above aprties xxx the survivor of us shall have the whole crop of corn and team yt then shall be in our holding when a change shall come And to avoid trouble: that this same may be done Authenticke in Law to all intents and purposes: wee have to that end delivered and ----glish halfe crowne poore in silver to interest one the other in the whole of all our worldly substance after the first discordant[?] of either of us And to manifest this to be our absolute and voluntary deed of gift eath to the other immoveable we have hereunto sett out hands and seales this twenty first of February 1707/8. 14 OCTOBER 1708: THE WITHIN WILLIAM QUALTROUGH and DOROTHY HIS WIFE have acknowledged the within Deed of Gift their mutual act and Deed before me, Joh. Parr. THIS DEED OF GIFT HAVING PROVED before ye Deemster it is accepted for ye last will of WM QUALTROUGH & his WIFE DOROTHY xxxx in Court in form of Law. Acceptum est & Solvit 1s. Pledges in form of Law Hugh Shimmin & Philip Kewley."
