"Patrick: This is affirmed to be the last will and testament of ELLIN RADCLIFFE ALS BRIDSON who departed this life about the middle of March 1688/89, being in perfect memory at the making thereof. First, she committed her soul to God and body to Christian burial. Item, to the poor a firlet of meal to be distributed the day of her burial and 3 half firlets of barley to the poor at All Saints after. Item, she left her part of the grounds that her HUSBAND & she bought wholly to him if he survive and her part of a fishing boat. Item, to her ELDEST BROTHER 10 shillings. Item, she left to her SISTER MARJERY 10 shillings. Item, to her said SISTER MARJERY a suite of clothes, and to her CHILDREN a sheep and a lamb apiece. Item, to WILLIAM COOPER's WIFE her choice garment. Item, to ELLIN MACLEVORRY a blanket and sheet out of the whole, which was her own and a pail, and half an heifer, the other half whereof here HUSBAND hath consented to give also to the said ELLIN. Item, she left to RICHARD GELL's SON in ox xxxx of a year old and a lamb to her BROTHER IN LAW'S SON THOMAS. Item, to her SISTER IN LAW ELLIN: RADCLIFFE a suite of Holland. Item, to the minister a mutton. Item, to the clerk a goose at Michaelmas. Item, she constitutes and appoints her FATHER, MOTHER, and BROTHER WILLIAM her lawful Executors of all the rest of her goods moveable and unmoveable whatsoever. RECEIVED FROM HENRY RATCLIFFE of Raby, the sum of thirty shillings sterling in payment of what was due and coming to me, I say received the sum of 01:10:00, as witness my hand and mark this 13th of December 1689, by me NICHOLAS BRIDSON. MORE OVER, I DO ACKNOWLEDGE and confess to have received at, and from the hands of the said HENRY RATCLIFFE, an ox which is in my own keeping, the summer pasture included therewith at the rate and priced of thirty shillings xxxx more which makes up the sum of three pounds, He the said HENRY RATCLIFFE paying over and above the sum of fifteen shillings for the crop of corn proportionable due to me, as witness my had and mark the day and year above, [signed their marks] NICHOLAS BRIDSON, HENRY RATCLIFFE. Received from HENRY RATCLIFFE Raby the sum of three pounds three shillings in part of payment of the goods of my SISTER RATCLIFFE ALIAS BRIDSON as witness my hand this 13th of December 1689. THE ADMINISTRATORS OF ELLIN BRIDSON vizt., NICHOLAS & WILLIAM BRIDSON with WILLIAM TAGGART, agreed with HENRY RADCLIFFE HER HUSBAND after the making of her decree to give them for her part of goods, twelve pounds in all as appears by that Inventory xxx themselves put upon Record which mentioning the said sum to be by agreement with the husband 12:00:00. Of which sum of 12 pound paid unto NICHOLAS BRIDSON as follows: Imprimis, in xxxx of what was in the house 01:04:06; Item, in earnest betwixt himself & WM TAGGART 00:01:00; Item, in moneys the 13th of December 89 01:10:00; Item, in moneys being the price of an ox in his own keeping 01:10:00; Item, in an horse at the rate of 01:03:00; Item, in another horse at the rate of 00:13:00; Item, in moneys on St Patrick's Day 1690, 01:00:00; Item, at another time 00:00:06; Received by him in all 07:02:00. BUT IT IS OBJECTED by NICHOLAS BRIDSON that the Inventory betwixt goods, moneys & lands should have been by agreement xxx after making the xxx in all 18:00:00. Which if HENRY RADCLIFFE grant, yet tis satisfied as follows: First, in the above sum 07:02:00; Item, to WM BRIDSON as much (if not now then) 07:02:00; Item, in the lands bought by HENRY & HIS WIFE her part & her part of the fishing boat and netts with her part of the xxxx house all left unto HENRY by his WIFE's will, which afterwards was found and disannulled the Decree, being valued (his part) at xxxx to 04:04:00. WHEREAS THIS WILL COULD NOT BE FOUND that time when a Decree was made on the fore said ELLIN BRIDSON it being in the custody of Mr. WATLEWORTH, and now being produced to the Court for probation and allowance; we have accepted xxx and granted Administration to one of the Executors in behalf of himself and mother, empowering them to take and receive the goods and chattels of the fore said ELLIN BRIDSON from all and every person and persons that have any of the said goods and chattels in their hands by virtue of the former Dxxxx or Administration granted and made in this behalf and whosoever will not yield evidence hereunto, the Sumner required to commit them into St Germans prison and in case of further dixxxxx to xxxx the assistance of a soldier from the next garrison. XXXXX OF WHAT I PAID NICHOLAS BRIDSON xxxxxx him as appears by the within acquittances in moneys 1 pound 10 shilling and in an ox 1 pound 10 shilling, in all 3:00:00; Delivered him a horse at the rate of 1:03:00; Item, delivered him a horse at 13 shillings and a fledge 7 s 1:00:00; Paid him in earnest xxxx buying the goods, at one time 1s, another 6p 00:01:06; TOTAL 5:4:6. Paid out on my wife's funeral as appears by a note of the particulars, the sum of 1:17:09.
MARCH 25TH 1691: RECEIVED THEN FROM & AT the hands of my BROTHER IN LAW HENRY RADCLIFFE of Rabey the just sum of twenty seven shillings six pence, on the account of a debt he owes me, which is now satisfied all to 20s xxxx of which 20s the said HENRY RADCLIFFE would make deduction for my SISTER's funeral charges xxx that xxxx is referred to trial. 27TH JUNE 1691: THIS DAY THE ABOVE xxx xxxxx HENRY RATCLIFFE and my self came to a xxxxxxxxx due to me from the sum of ten shillings xxxx I have this day received being the xxxx of that sum of forty seven shillings and six pence and do by these presents xxxxx acquit xxxx xxxx that HENRY RATCLIFFE his heirs and assigns xxxx xxxx for the said sum by xxxxxx my executors and assigns here after and do bind xxx xxxxxx for the true performance of the same. I say received by me of ten shillings by me WILLIAM BRIDSON.
Item, expended by the HUSBAND in the funeral of his WIFE and her burying as appears by a bill of the particulars 04:05:11, + 07:02:11, + 07:02:00, + 01:13:11, IN ALL 19:13:11. xxx that HENRY RADCLIFFE has due unto him from the Executors of his WIFE by this account xxxx thou he should grant the Inventory of 18 pounds to be xxxx, which cannot be proved. Besides what WILL: BRIDSON had from HEN: RADCLIFFE over and above this account in respect to his condition & civilitie.
As to what Mr. LOONEY & JO: STEVENSON xxxx[?certified] in the settling of accounts betwixt HEN: RADCLIFFE & NICH: BRIDSON, It was upon mistake and forgetfulness of HENRY that did not then know how much he had before paid unto NICH:, & therefore ought not (in my opinion) be of xxx against the said HENRY; who has paid the full Inventory take them either way; & the said Receipts were acknowledged by the fore said NICH: & WILLIAM BRIDSON the 3rd of July 1696, before me Sam: Watleworth.
THE PRICE OF THE GOODS left to HENRY RADCLIFFE by his WIFE ELLIN's will: The lands they bought of Philip Taylor, cost 3 pound 10 shilling & a blanket at 4 s, her half thereof being 01:17:00; Her half of the moneys laid upon part of trelgie ground 00:15:00; Her part of the boat and nets 01:00:00; Her part of the riding horse 00:12:00; TOTAL 04:04:00.
AUGUST 11TH 1696: HENRY RADCLIFFE having consented to this account it is ordered that the within named NICHOLAS & WILLIAM BRIDSON repay unto the said HENRY the within sum of 1 pound 13 shilling 11 pence, equally betwixt them, which they have received over and above what they can pretend to either by Inventory or agreement which if they or either of them refuse to repay within 14 days, the Sumner to commit them or them into St Germans prison, there to remain till they submit to Law and pay all fees.
