The humber petition of Elizabeth Cain of the parish of Braddan, Widow.
Sheweth. That Alexander Cain of the said parish of Braddan your
petitioner's husband some short time since departed this life having
made and published his last will and testament noncupative(oral)
whereof he appointed the petitioner executrix.
That petitioner is desirous that the said will should be received and
probate thereof granted to her in the usual form. Wherefore petitioner
prays a hearing hereof and that your Reverence may be pleased to receive
the said will and grant probate thereof to petitioner and she will pray.
Ordered that this petition do come on to be heard at a court to be holden
at Douglas on Friday next whereof all proper parties sho are due notice.
Given this 16 day of June 1845. J. R. Martwell.
At an Eccl Court held in Douglas the 20th June 1845 upon hearing this
petion in presence of the parties and their advocates and upon examining
Matthias Caine and Jane Caine witnesses to the will of Alexander Cain. I am of opionion that probate ought to be granted on the said will as
prayed for and the same is therefore hereby so ordered adjudged decreed accordingly. T. A. Corlett.
This is affirmed by the subscribing witnesses to be the last will and testament of Alexander Cain of Algaar in the parish of Kirk Braddan. He being in the opinion of the witnesses of sound and disposing mind,
memory, and understanding, at the time he uttered and dictated the same being on the 21st day of May instant. He left and bequeathed unto his
four sons namely John, William, Thomas, and Alexander Cain the sum of two pounds each, and he nominated and appointed his wife Elizabeth Cain
whole and sole executrix of this his last will and testament and residuary legatee of all the rest of his goods and effects movable and
immovable of what kind name and nature soever as witness our subscriptions this 26th day of May 1845. Matts Cain and Jane Cain.
Elizabeth was sworn in as executrix with pledges being Wm Quilliam and J Skillicorn.
Robert Christian Guardian of John Cain a minor and legatee named in the foregoing will of his father Alexander Cain appeared at this registry and
acknowledged to have received and been paid the legacy of two pounds bequeathed the said Jno Cain in and by the said will. And he the said
Robert Christian hereby exonerates requits and discharges the executrix Elizabeth Cain her heirs executors and administrators and assigns of the
same and of every part thereof as witness his subscription or mark to his name this 29th day of July 1846. Robert Christian his x mark
