In the House of Keys on the 17th October, the Attorney-General (Mr. R. B. Moore) presented to the House an illuminated book containing the roll of members of the House of Keys from the year 1417 to the present time. This work, which is of great historic interest, will be preserved in the House. The list contains five hundred and twenty-five names. The records consulted are the Acts of Tynwald, which are regularly signed by the members of the Court; the Liber Scaccarii, or Book of the Exchequer, containing records of decisions given by the House of Keys in their judicial capacity; and the Liber Juramentorum, or Book of Oaths. The names are lettered, page by page, on parchment, and the book is bound in vellum; and the artist, Mr. John H. Nicholson, has a frontispiece of Tynwald Hill.
Prefaced to the book is a short introduction. It is in the form of a letter addressed to the Speaker, and reads
Dear Mr Speaker, It will be within your knowledge that a committee of the House of Commons has been engaged for some years past in compiling a complete list of members of that Honorable House.It appeared to me that so excellent a course might with advantage be followed in our Island, and I have accordingly searched our ancient records and from the documents available I have prepared the attached list of members of the House of Keys.
Our records do not go back beyond the year 1417, and the list therefore only covers 516 years of the life of the Keys. That this branch of Tynwald is of much earlier origin is obvious from the reference in the procedure of Tynwald prepared for the guidance of the King of Mann in 1417 'the worthiest men in your land to be called before your Deemsters' undoubtedly refers to the Keys, and the King is informed of the procedure that had been followed since the days of Orry approximately A.D. 913.
Written records exist from the commencement of the Stanley regime, and the roll of members is compiled from
(1) the Acts of Tynwald from 1417;
(2) the Liber Scaccari from 1585;
(3) the Liber Juramentorum from 1775. Those from the first source are unfortunately incomplete. Many persons who were members of the Keys did not sign any Act of Tynwald; but from the beginning of the Lib. Scac. in 1585 the list was recorded each year and is complete to date.
This is not the place to discuss the origin of the name of your Honorable House, or to trace the history of its development. The former is the subject of controversy among scholars, while the latter is obvious to every student of our statutes. It is, however, interesting to note that the name ' Keys' does not appear until the year 1422.
In our earliest records they are spoken of as 'the Four and Twenty,' which in Manx would be the ` Kear as feed' or the 'twenty four of the land.' They are first referred to as the 'Keys' or 'Keyes' in 1422, when their alternative name of 'Taxiaxi' is referred to.
The earliest function of the Keys was to declare the ancient common or breast law with the Deemster, when any question of doubt or difficulty arose. They were the chief quest and the final court of appeal.
From declaring the old law to making new law was a natural development. Down to the year 1577 the Keys ` gave for law' what the breast law was. The transition stage is seen in paragraph 3 of the statute laws 1585, where it is stated : 'The two deemsters, with the advice and consent of the XXIIII Keyes here assembled do enact and give for law that etc. In 1610 the function of law makers is clearly recognised in the preface to the Acts : 'Att an assembley of the Lieutenant and other the officers with the 24 called the Keyes of the land, for the consulting and determining of matters concerning the state of the land, there was these statutes ensuing made and enacted.'
The Keys retained their judicial function until the year 1866, when they changed from being a co-opted body and became an elected body.
I recall with pride the fact that I had the honour to be a member of the Keys for a little over one year before being appointed to my present office, and I respectfully ask the Keys. to accept this roll with my sincerest respects.
The Attorney-General has favoured the Journal with a copy of the list of names, and it is therefore an honour to be enabled to publish it for the first time.
