COVENANT OF MARRIAGE

BETWEEN ERIC, KING OF NORWAY, AND MARGARET, DAUGHTER OF ALEXANDER, KING OF SCOTS, WHEREIN MESTION IS MADE OF PRETENSIONS TO THE ORKNEYS AND TO THE ISLE OF MANN. A.D. 1281.

 

 

 

 

IN the Name of the Father, and of the Son, and of the Holy Ghost, Amen. This is a final concord made on the Feast of St. James the Apostle, in the year of our Lord one thousand two hundred and eighty-one, at Rokesburg

Between the illustrious prince, lord Alexander, by the grace of God, King of Scotland, in his name and in the name of the noble damsel Margaret, his beloved daughter, by the consent of lord Alexander his son, and of the whole council of the said lord the King on the one part, and the venerable father lord Peter, bishop of Orkney, and the noble lord Berners baron [of Berkrey,] master Bernard the chancellor, and brother Maurice of the order of Minors, vicars, and solemn and special ambassadors of the lord Eryc, by the grace of God illustrious King of Norway upon the other part, respecting the espousals contracted, and the marriage to be contracted between the aforesaid lord the King of Norway, and the said noble damsel Margaret, namely

That the King of Scotland gives the same Margaret his daughter to the said lord Eryc, King of Norway, to wife.

XXIV.-The said King of Scotland has assigned to the said King of Norway, (for losses, expenses, and interest in that matter alone, if the said daughter of the King of Scotland should depart from the said contract before the said King of Norway shall attain to the age of fourteen years complete, and the marriage be ratified,) the whole of Mann, with all the right which the said King of Scotland has or shall have in the same.

So that the said land with appurtenances may from that time forth belong to the said King of Norway and his heirs, in fee and heirship, if the said daughter of the King of Scotland shall be unwilling to ratify and consummate the said marriage, or to make amends to the said King of Norway, his heirs or assigns, for losses, expenses and interest, together with the aforesaid amend of one hundred thousand pounds.

And the instruments of quit-claim of the said King of Norway upon the said Isle of Mann, which the said King of Scotland holds in his possession shall from that time be wanting in effect, and be by law void and of no value.

The instruments of the said King of Scotland respecting the said sum of one hundred marks, to be paid annually, remaining in the possession of the King of Norway continuing in full force.

XXV.-And be it known, that the assignment of the land of Mann has force only from the time of the passing over of the said Margaret, and only in that matter, if the said Margaret shall be unwilling to ratify the marriage, when the said King of Norway shall have completed his fourteenth year.

XXVI.-And be it known, that in all the premises it is lawful for both parties, that the period at which the money should be paid, may be changed or delayed on both sides, for a certain term, on account of war or pirates, or any other fortuitous and unforeseen cause, without danger, prejudice, or loss to the parties in the premises.

XXXIV.-Likewise the said King of Scotland has assigned the whole of Mann with appurtenances for one hundred thousand pounds, and losses, expenses, and interest in that matter, if, when the said King of Norway shall have completed his fourteenth year, and shall, as far as in him lies, have consummated the marriage at Berewick, he does not set at liberty the said sureties* (if he shall have first received them there) unless death or some other legitimate cause shall hinder him, or that they shall with- draw of their own free will.

In testimony whereof, the said representatives of the King of Norway have affixed their seals to the portion of this cyrograph remaining in the possession of the King of Scotland, but to the part remaining in the possession of the said representatives, the seal of the said lord the King of Scotland is appended.

IN nomine Patris, et Filii, et Spiritüs Sancti, Amen. Hæc est finalis conventio, facta in festo sancti Jacobi apostoli, anno Doxnini inillesimo ducentesimo ootogesimo primo, apud Rokesburg ;

Inter illustrem principem, dominum Alexandrum, Dei gratia, Ren-ein Scot' nomitue sno, et nomine nobilis domicellæ Margaretæ filiæ suæ karissimæ, de consensu domini Alexandri filii smi, et tobus consilii dicti domini Regis, ex parte una;

Et venerabilem patrem, dominum Petrum Orchadensem episco- pum, et nobiletn virum dominum Bernardum baron [de Berkrey,] magistrum Bernardum cancellarium, et fratreni Mauritium de ordine Minorum, procuratores et nuncios sollempnes et speciales domini Eryci, Dei gratia, Regis Norwagiæ illustris, ex altera

Super sponsalibus contractis, et matrimonio contrahendo, inter, præfatum dominum Regem Norwagiæ, et dictam nobilem domicellam Margaretam, videlicet

Quod dominus Rex Scotiæ dat dictam Margaretam filiam suanl dicto domino Eryco Regi Norwagiæ in uxorem.

XXIV.-Obligavit etiam dictus Rex Scotiæ dicto Regi Nor- wagiæ (pro dampnis, expensis, et interesse in illum casum tamen; si dicta filla Regis Scotiæ a dicto contractti resilierit, antequam dictus Rex Norwagiæ fuerit quatuordecim annorum completorum et matrimonium fuerit ratificatum) totara Manniam cum omn, ure quod dictus Rex Scotiæ habet, vel habere poterit in eadem ; Ita quod prædicta terra, cum pertinentiis, dicto Regi Norwagiæ, et hæredibus suis, ex tune remaneat, in feodo et hæreditate, cum dicta filia Regis Scotiæ dictum matrimonium noluerit ratificare et consummate, vel dampna, expensas, et interesse, una cum prædicta peenå centum mille libraram, dicto Regi Norwagiæ, vel hæredibus suis, vel assignatis resarcire

Et instrumenta quieta clamationis dicti Regis Norwagiæ super dicta insulå Manniæ, quæ dictus Rex Scotiæ penes se habet, ex tune viribus careant, et cassa sint, et irrita ipso jure;

Instrumentis dicti Regis Scotiæ, super dictå summå pecuniæ centum marcarum, amiuatim percipiendå, penes Regem Norwagiæ residentibus, in suo robore duraturis.

XXV.-Et sciendum est, quod obligatio de terra, Manniæ tantum habet locum a tempore transfretationis ipsius Nlargaretæ ; et solummodo in illum casum, si dicta Margareta noluerit matri- monium ratificare, cum dictus Rex Norwagiæ fuerit quatuordecim annorum completorum.

XXVI.-Et sciendum est quod, in omnibus præmissis, salvum est utrique parti, quod tempus, quo pecunia solveter, pro quolibet termino, ex utrique parte, per guerram, per piratri, vel per altquem casum fortuitum et inopinatum, possit mutari sen proro- gari, sine periculo partium circa præmissa, præjudicio vel jacturå.

XXXIV=Obligavit etiam dictus dominus Rex Scotiæ totara Manniam, cum pertinentiis pro centum millibus librarum, et dampnis, expensis, et interesse in illum casum, si dittos obsides, eum dictus Rex Norwagiæ compleverit quatuordecim tinnos, et matrimonium, quantum in ipso est, consummaverit aped Berewie' (si eos prius ibidem receperit) nisi casas mortis, vel aliis casas legittimus præpedierit, vel propria voluntate recesserint, libere non dimittat.

In cujus rei testimonium, parti istius cyrographi, penes dominum Regem Scotiæ residenti, dieti procuratores Regis Norwagiæ sigilla sua apposuerunt.

Parti vero residenti penes dietos procuratores, sigillum dieti domini Regis Scotiæ est appensum.
