[From Atholl Papers - AP 49(4th)-40]
My Lord Duke
The actions that are raised against the Tenants of the Mines are evidently part of a systematic plan attempted to be carried into execution in every possible way to reduce the value of your Grace's property and interest in the Island.
The several proprietors below the Mines complain of the Water being polluted by the operation of washing the ore, & some of them, particularly the proprietor of a Paper Mill applied for a Trespass Jury who are sure to find damages due, and the Tenants come to Mr Roper & myself as acting for your Grace to defend them.
It is clear on the one hand that the Tenants stand so far in your Graces shoes, having all the right to work the Mines that you can give, and therefore, they can have no more to ask, but on the other hand, if they cannot use the Water, they cannot work the Mines, and every thing considered, it seems proper that a case should be made out for a solid opinion of Counsel as as it may be ascertained what is the proper course to follow.
I enclose Mr Ropers letter to on the subject, to which I refer, and as Mr Knott & Mr Kycke are to be here next week I should be glad to have your Graces directions herein. I have the honor &c..
