South Side Sale, May 1774 #96 Rushen

Henry Gawne to John Quayle and Edward Kinley - Sale

Know all men by these presents that I Henry Gawne
of the Rowany in the parish of Trinity Rushen Divers
good Causes and Considerations me hereunto moving
but especially for and in Consideration of the sum of
three pounds Currency of this Isle, Paid unto me – 
before the Signing & Delivery of these presents the
Receipt whereof I do hereby acknowledge at by and 
from the Hands of John Quayle and Edwd Kinley
of the sd Parish, Have Given granted passed over
alienated and Sold, and by these presents do Give
Grant pass over and absolutely Sell unto the aforesd
John Quayle and Edwd Kinley, their Heirs Exrs Admrs
and Assigns a certain part of my Quarterland
of the Rowany aforeaid, (Viz) under the following
dimensions, from the north gable of  Charles Lindsey’s
House in Portern, Lately erected, the length of fourty
yards northward along the full-sea mark, and fourteen
yards in breadth toward the east, of such yearly Lords ^rent^
as the Setting Quest of the Said parish Shall settle
and proportion upon the premisses, They the said
John Quayle, and Edwd Kinley, paying Yearly & 
every Year the sd Lords rent, and to do and
perform Such Suits and Services as may be – 
incumbent upon the premisses at the times &
seasons usually practized within this Isle, and
I the Said Henry Gawne do hereby bind and
oblige my Self my Heirs Exrs Admrs and Assigns
firmly by these presents to uphold Maintain – 
awarrant and defend the premisses as afore
sd unto them the sd John Quayle & Edwd Kinley,
their Heirs Exrs Admrs and Assigns against the

the pretended right or Claim of any person or
persons Whatsoever, the right of the Most Noble
Lord of this Isle only Excepted, and I the said
Henry Gawne do hereby further bind and
oblige my Self, to procure the Worshipful
Deemster’s attestation to this Deed and the – 
Honourable Courts Confirmation, and to do
and perform whatsoever may be further – 
Necessary to Secure them the sd John Quayle,
Edwd Kinley, their Heirs Exrs Admrs & Assigns, in
the peaceable possession of the premisses. – 
Note, the sd John Quayle, and Edwd Kinley are to
be Equally in Said premisses, and to pay
the Lord’s rent Equally between ‘em with
all Dues & Duties.  For the true & faithful – 
performance hereof I the Said Henry Gawne
do bind my Self my Heirs Exrs Admrs & Assigns
firmly by these presents in the penalty and
forfeiture of fourty pounds Sterling to be
paid and recover’d according to Law, as
Witness my Name & Mark this 26th Jan:1773

    At a Baron or Sheading Court holden at Castletown
    for Rushen Sheading the 17th May 1774
The before written Deed of Sale being acknowledged before the
Deemster and now openly published in Court and no objection
offered agt it the same is therefore allowed of for and in the
the name & behalf of the most Noble John Duke of Atholl
and Charlotte Duchess of Atholl Lord and Lady of the – 
Mannor and Confirmed by this Court
