John Quayle to Joseph Qualtrough & Thomas Kinley

KNOW all men by these presents that
I John Quayle Junr of the White Stone by and
with the consent of my wife Elizabeth Quayle
als Looney of Ballasalley in the Parish of
KK Malew for divers good causes and valu=
=able considerations us hereunto moving but
chiefly for and in consideration of the full
and Just sum of Four Hundred pounds
British currency to be unto us paid at the
twelth of Febry next Ensuing the date hereof at
by and from the hands of Joseph Qualtrough
and Thomas Kinley of KK Christ Rushen equal
=ly between them and the mortgage on the premises
es hereafter mentioned to be paid out of the afore
=sd consideration sum Have therefore given
granted bargained passed over and sold and 
do by these presents give grant bargain pass
over and for ever absolutely sell from us unto
them the sd Joseph Qualtrough and Thomas
Kinley Equally between them a certain parcel
of our Estate called Lieuayg’s Hill being Abbey
Demesne bearing the annual Abbey rent of
nine shillings and seven pence half penny
or there abouts and adjoining to the publick
high Road leading to Castletown on the north
West to the Worshipfull Deemster Moore’s
rent on the East and South and to a Road – 
leading to Challoo Garret on the South West
from us our heirs Extrs admtrs and assigns
To have and to hold unto them the sd Joseph
Qualtrough and Thomas Kinley and their
heirs Extrs admtrs and assigns the aforesaid
premisses with all its appurtenances and
priveledges whatsoever and in any wise
appertaining commencing possession at or
upon the twelth of February next Ensuing the
date hereof without the Disturbance of any
person as it Lyeth situate in sd parish –

And they the sd Joseph Qualtrough and
Thomas Kinley Yielding and paying the
annual Abbey Rent with all other customs
and Incumbrances annually Incumbent on
the premises and they the sd John Quayle
and his wife Elizabeth Quayle binding and
[obscured by fold] themselves ?? uphold maintain
and defend the premises to them the said
Joseph Qualtrough and Thomas Kinley
against any manner of person or persons
pretending to the contrary hereof and also
to procure the worshipfull Deemster’s at=
testation hereof together with the Honour=
able Courts confirmation hereof and to do and
to act all things necessary in Law for them
the sd Joseph Qualtrough’s and Thomas – 
Kinley’s better security and assurance of
the aforesd premises.  And for the true – 
and faithfull perfoemance hereof the par=
ties herein concerned do hereby bind and
oblige themselves their heirs Extrs admtrs
and assigns in and Under the penalty of
Eight Hundred pounds Brittish to be Levy’d
and paid according to Law and in witness
whereof they have hereunto subscribed – 
their names this 1st January 1787 –

Nota Bene  And it is provided and agreed
upon by the parties that John Quayle and
his wife are to put their part of the Fences on
the premises aforesd in good and Tenantable
repair as agreed upon before the signing of
this deed

At a Court Baron ^or Abbey Court^ holden at the House of William
Armstrong near Douglas the 16th day of May 1787 – 

The beforewritten Deed of Sale being acknowledged before the High 
Bailiff Deemster, and now openly published in Court, and no – 
objection offered against it – The same is therefore allowed of for and in
the name and behalf of the Most Noble John Duke of Atholl and
Strange Lord of Mann and the Isles &c and confirmed by this
Court –
