South Side Sale, May 1773 #101 Malew

Thomas Kinley to Robt Shimin

Know all Men by these presents that I Thos –
Kinley of the parish of Malew with the full – 
Consent and assent of My Wife Isable Kinley
als Creer of the parish of Malew ^aforesd^ Divers Good
Causes Us hereunto Moving But More Especially
for and in Consideration of the full and Just Sum
of Twenty Seven pounds Currency of this Isle now
to us in hand paid / the Receipt & Whereof We do – 
hereby Acknowledge / at By and from the hands of – 
Robt Shimin of sd parish Have Given Granted
passed Over and Sold And Do by these ^presents^ Give Grant
Bargain pass Over and for Ever Absolutely sell
from Us Our Heirs Exrs Admrs and Assignes unto
him the sd Robt Shimin his Heirs Exrs Admrs
and Assignes all the Right Tytle Interest and property
that we now have or hereafter May Might or Could
have of in and Unto a Certain Small platt of Land
Situate and Being Near Balla Salla Commonly Called
and Know by the Name of Kinleys Croft.  And –
adjoining to the Rent of Ann Norris of the North East
to Robt Harrison on the South East to Paul Queerk
on the South West and to John Quayle on the North
West the Same Being of the Annual Abby Rent of
Nine pence or thereabouts be the Same more or Less
To Have And to Hold unto him the sd Robt Shimin
the premises aforesd With all Ways Waters Water
Courses Easements and Liberties thereunto Belonging
??? the sd Robt Shimin his Heirs Exrs Admrs or
assignes paying Yearly and Every Year the aforesaid
Rent together with all Dues Duties Boons Suits and

Services Due and payable out of the Same.  And
for the further and Better security of the aforesd premises
I the sd Thos Kinley and Isable my Wife Do hereby – 
Oblige our Selves our Heirs Exrs and Assigens to – 
Uphold Awarranty and Defend the premises aforesd
Against the Claim Challenge or Demand of any person
or persons whatsoever  And to [line obstructed by fold and smudge]
Deemsters Attestation with the Honble Courts – 
Confirmation to these presents And to ?? perform
and fulfill all other and further Act or Acts thing or
or things that in Law Shall or May be Sufficient for
the Sure Strenghening of these presents  And for the
true and faithfull performance Whereof We Do – 
hereby Bind and Oblige our Selves our Heirs Exrs
Admrs and Assignes in and Under the penalty and 
forfeiture of Sixty pounds Sterl to be Levied and paid
According to Law.  As Wittness Our Marks to Our Names
this 4th of March 1772

Castletown the 30th June 1773.

The before written Bill of Sale being acknowledged before
the Deemr & now openly published in Court & no – 
Objection offered agt it.  The same therefore is allowed
??? for & in the name & behalf of the most Noble John –
Duke of Atholl & Charlotte Duchess of Atholl Lord and
Lady of the Mannor & Confirmed by this Court.
