Where as there has been of late some misunderstanding and disagreement betwixt John Cannel of BallneCooley in the parish of Kk Michael and Catherine Cannel als Caine his wife And for as much that the sd couple cannot live peaceable together as becometh husband and wife, wch is altogether long of some evil neighbours who sowes discord and contention amongst them with a design to partake of their lands & effects by a fraudulent way and to prevent such proceedings and to keep their said Lands from being any way squandered and embezled it is this day agreed upon by the above said John Cannel & Catherine his wife and Adam Caine father of the sd Cath that ye said lands shall be set and let by the sd Cannel himself and some provision made for his only child during her minority and whilst they liver seperate First It is agreed upon yt afforesaid John Cannel do reserve and keep to his own proper use and advantage all his lands in the tenement of Ballne Cooley as well quarterland and intake to be disposed of by himself by way of setting or ye like or left lay let him live in what part of ye world he will and this to be during his natural life Secondly It is agreed that he the said John Cannel after his decease do settle resign and surrender all his lands in tenemnt of Ball= neCooley as well quartr land as intake upon the lawfull issue begotten betwixt himself and his wife Catherine Thirdly It is further agreed upon that ye sd John Cannel doi hereby bind and oblige himself not to dispose of any part parcel or member of his said lands either by saile or mortgage but yt it shall be forth coming for ye lawfull issue as before mentioned Forthly It is agreed upon that he ye said John Cannel in consideration that he may have his free liberty and not hereafter be disturbed nor molested by his said wife or any of her friends or relations let him live in what part of ye Island he will upon that acct do immediately give towards the childs maintaines ten shillings now in hand, and four shilling yearly till ye sd child arrives at the age of twelve years And for the just performance of the within agreement both parties do bind & oblige themselves in the penalty and forfeiture of forty pounds the one half to ye Honrable Lord of this Isle and the other other half to the ye party agrived and to witness the same they have set their marks to their names this 24 Novembr 1740 John Cannel his x Cath Cannel als Cain her x Adam Caine his x Signed and delivered in presence of John Cannel his x Tho Cannel 20th Octobr 1742 John Cannel and Adam Caine acknowledged the within and above deed of agreement and settlement to be their voluntary Act and Deed before me Dan Mcylrea 3rd May 1748 Catherine cannel acknowledged the within and above deed of agreement to be her voluntary act and deed before me Dan Mcylrea At a Sheading Court holden at Peeltown the 5th May 1748 ... allowed of and confirmed according to law
