KNOW ALL MEN by these Presents that we Robert Looney and Margaret Looney of the Parish of Maughold divers good Causes and valuable Considerations us hereunto moving but Chiefly for and in Consideration of the sum of Two-hundred pounds good and lawful money Currency of Great Britain to us to be paid in manner herein after mentioned by our eldest Son and Heir at Law John Looney that is to say One half thereof on the 12th day of November 1826 and the other half of the sd. sum to be paid ____ to our Executors or Assigns on the decease of the __ survivor of us Have therefore Given Granted Settled and Estated and by these Presents Do Give Grant Settle and Estate unto and upon our said Son John Loney his Heirs Executors and Assigns All and Singular our Estate Lands and Premises in the sd. Parish of Maughold where we now live Consisting of parts of the __ Quarterlands of Ballakilley and Ballaterson which we purchased from the Revd. John Nelson and Wm. Callow and bounded on the South by the Lands of Capt. Hugh Crowe on the west and north west by the Lands of Edwd. Christian Ballaterson on the north and north East by the Sea shore and on the East and South East by the Glebe and part of Ballakilley and of such annual Lords Rent as may be Settled thereon To have and To Hold unto him the said John Looney his Heirs Executors and Assigns All and Singular the sd. Estate Lands and Premises together with the Houses offices and Concerns thereon erected and all ways waters water courses __ Easements, Liberties Rights Members and appurtenances to the same belonging, but subject to the reservations herein after mentioned And Commencing possession of the one half of the sd. Lands and outoffices on the 12th day of Novr. next and of the other half of the sd. Lands outoffices and Concerns on the death of the Survivor of us and not sooner. Hereby reserving to ourselves And the Survivor of us the Sole and exclusive use of the Dwelling or Mansion House and small Garden in front thereof during our natural lives or the life of the Survivor of us. And hereby Charging incumbering and making subject the Whole of the sd. Lands to the paymt. of the balance of the sd. Consideration sum which may be due at the time of the death of the sd. Survivor of us _ And we the sd. Robert Looney and Margaret Looney Covenant to and with the sd. John Looney his Heirs and Assigns that we have good right and title to Grant Transfer and Settle the sd. Estate Lands and Premises in manner herein granted and to maintain warrant and defend him and them in the quiet enjoymt. thereof against the Claim Challenge and demand of all other persons whomsoever. _ And I the sd. John Looney as a further Consideration for this Deed of Settlement do hereby Bind and oblige myself my Heirs and Assigns not to Set or Lease any part of the hereby Settled premises to any person during the life time of the sd. Robert Looney and Margaret Looney without their Consent And also to live on the same and work the sd. Lands or my own share thereof to the best advantage. And I further agree __ and bind myself my Heirs Executors and Assigns to abide by this Deed of Settlement and to do and perform all Conditions therein mentioned and also to pay the one half of the yearly Interests arising on the several Mortgages and Securities Chargeable thereon calculating the same from the time of possessing the one half of the sd. Lands which is to be on the 12th Novr. next. _ And we the said Robert Looney and Margaret Looney bind and oblige ourselves and the Survivor of us to keep the one half of the sd. Lands Offices and the sd. Dwelling - house in tenantable Condition and repair And not to Set or Lease the same or any part thereof without first giving our said son John Looney the first offer or refusal of the same on such terms and Conditions as any other person may offer or propose for the same And for the true and faithful performance hereof we the sd. Robert Looney, Margaret Looney and John Looney bind and oblige ourselves our Heirs Exors. and admons. the one to the other in and under penalty of Two thousand (sic) pounds Currency aforesd. to be levied and paid according to Law. _ witness our __ subscriptions this 13th May 1825. ___ Robert Looney his X. _ Witnessed by } Margaret Looney her X. _ John Christian John Loony Robert Corkill his x. _ 13th May 1825. _ Robert Looney, Margaret Looney and John Looney the executing parties to the foregoing Deed of Settlement acknowledged the same to be their proper Act and Deed. Before me Thomas A. Corlett At a Court Baron holden at Ramsey the 20th October 1825 - The foregoing Deed having been acknowledged before a High Bailiff and now openly published in Court and no objection offered against it the same is therefore Ordered to be Recorded [J: Quine] [Genl] Office 9th January 1832 The Consideration money discharged by the annexed Rect. __ By me __ [J Quine] ……… Maughold Eleanor Looney To John Looney Discharge Whereas Robert Looney and Margaret Looney of the Parish of KK Maughold For and in Consideration of the sum of Two Hundred Pounds British Currency - did by deed by them executed and bearing date the 13th of May 1825 Grant Settle and Estate to and upon their eldest son and Heir at law John Looney their Estate of Lands Called Ballaterson and Ballakilley - Subject to the Payment of the said Sum of Two Hundred Pounds british which, was to be a [lein] and charge upon the said Lands and premises and Payable to the Survivor or their Executors of the said Grantors ^ Robert Looney and Margaret or their Executors Looney ^ And Whereas the said Margaret out lived her said Husband Robert Looney. Whereby she became intitled to the said sum of Two Hundred Pounds british And Whereas the said Margaret Looney Having also departed this life but first duly made her will where by She Nominated and Appointed her daughter Eleanor Looney Executrix and Residuary Legatee by which said Will she became intitled to the said Two Hundred Pounds as by the said Will with a probate thereto dated the 7th of October 1831 may appear, __ Wherefore Know all men by these Presents that I Eleanor Looney Executrix of the Will of Margaret Looney Do hereby Acknowledge to have Received and being fully Paid by my Brother John Looney the said Sum of Two Hundred Pounds british the Consideration Mentioned in the deed of Settlement Granted to him by the said Robert Looney and Margaret Looney beraing date Estate the 13th of May 1825 Charging and affecting the ^ lands and Premises Called Ballaterson and Ballakilley situate in the Parish of KK Maughold for which I allow these Presents to be a full Receipt and discharge Hereby exonerating Releasing and discharging him the said John Looney his Heirs, Exors.
