Thos Kinley to Richd Cubbon - Sale

Know all men by these presents that I Thos Kinley – 
of the parish of KK Malew with the full and free consent of Ismy
Kinley als Gellin my wife Divers good causes and considerations us – 
hereunto moving but chiefly and more Especially for and in consideration
of the full and Just Sum of twenty pounds two shillings and six pence
manks unto us in hand paid ^from Richd Cubbon of sd parish^ Have Given Granted Bargained alienated
passed over and Sold and by these presents do Give Grant Bargain – 
alienate passover and for ever absolutely Sell from us the sd Thos – 
Kinley and Ismy my wife our Heirs Exers admers and assigns unto him
the sd Richd Cubbon his Heirs Exers admers and assigns all our Right – 
Tytle and Interest in and unto Certain Houses and Gardens Situate – 
in the parish of KK Arbory adjoyning to Beemaccan on the north – 
and to the Highway on the South and being of the annual Lords rent
of one penny or thereabouts To Have and to Hold unto him the sd – 
Richd Cubbon his Heirs Exers admers & assigns for Ever the premisses affore sd
with all ways waters and watercourses Easements Liberties – 
proffitts and advantages thereunto belonging or in any wise appertain=
=ing commencing from the day of the date hereof He the sd – 
Richd Cubbon His Heirs Exers admers and assigns Yielding and paying – 
Yearly & every year the annual Lords rent with all other Dues Duties – 
Boons Suits and Services Due and payable out of the premisses at – 
the times and seasons usual and Accustomed and I the sd Thos
Kinley and Ismy my wife do promise and oblige our Selves to – 
Secure and Defend the premisses unto him the sd Richd Cubbon
his Heirs Exers admers and Assigns [strikeouts] agt – 
all persons pretentious whatsoever and Cause the sd Richd
Cubbons name to be Entered Tennt according to Law and to – 
do any act or Deed that the Richd Cubbon Shall think – 
necessary or requisite in Law to Strengthen these presents

and for the Punctual Performance hereof I the sd Thos Kinley
and Ismy my wife Do hereby bind and oblige our Selves – 
our Heirs Exers Admers and assigns in and under the penalty
and forfeiture of Double the Value to be levied and paid – 
according to Law As Wittness our Names and Marks this – 
1st of June 1764

        Thomas Kinley and [strikeout] Ismy Kinley – 
        Acknowledged the beforegoing Bill of Sale
        to be their Voluntary Act and Deed and also
        Acknowledged to have received the full
        Consideration Money therein mentioned.

        Castletown for Rushen Sheading the 12th May
        1767
The beforegoing Deed of Sale being acknowledged before the Deemster and
now openly published in Court and no objection offered agt it, the same is
therefore allowed of for and in the Name and behalf of the Most Noble John
Duke of Atholl and Charlotte Duchess of Atholl Lord and Lady of the 
Mannor and confirmed by this Court
