Transcript of the Will of
John Fayle, 1841
Marown 1841
The humble petition of Wm Fayle Junior of the parish of Onchan.
Sheweth That John Fayle of Borshen in the parish of Marown your petitioner's
grandfather lately departed this life having on the 26th Nov1836 duly made
and executed a certain Deed of Settlement in favor of William Fayle of the
parish of Braddan your petitioner's father in the nature of a will and
disposing thereby of the whole of his personal
estate and appointing the said William Fayle sole executor.
That the said William Fayle is totally unfit to manage affairs and
petitioner therefore desirous of being sworn administrator of the estate and
effects of the said John Fayle deceased with the will annexed. Wherefore
petitioner prays a hearing hereof and that your Reverence may be pleased to
receive the said Deed as the last will and testament of the said John Fayle
and grant Letters of Adminstration with the said will annexed of the said
John Fayle's estate and effects to petitioner and he will pray.
Order that this petition do come on to be heard at Douglas on Friday the
29th instant whereof all parties to have notice.
Given this 18th January 1841 F. B. Drinkwater.
Episcopal Registry KK Michael 5th April 1842:
Charlotte Kennaugh wife of William a legatee named in the deed of gift
of John Fayle of Botchin in the parish of Marown deceased appeared at
the registry and acknowledged to have received and been paid the sum of ten
pounds British left to her in and by the said deed at the same time
and place appeared Ann Clucas widow and executorix of John deceased
and acknowledged to have been paid the sum of two pounds British also
appeared John Curphey husband of Mary and acknowledge to have been
paid the sum of two pounds British. Also appears John Fayle and Robt
Shimmin nephews of decease and acknowledge to have received each the sum of
five pounds British also the sum of five pounds British and also
the black horse "Punch" and they the said Charlotte Kennaugh, Ann
Clucas, John Curphey, John Fayle, Robert Shimmin, and William Shimmin
do hereby severally exonerate discharge and acquit William Fayle Junior
the administrator his executors, administrators, and assigns of the same and
of every part thereof as witness their subscription the day and date above
written.

Know all men by these presents that I John Fayle of Botchin in the parish of
Botchin in the parish of Marown for and in consideration of the natural love
and affection which I have and do bear to and for my well beloved
son William Fayle of Balla Cashin in the Abby lands of Braddan and for
and in consideration of the sum of five shillings to me paid by the said
William Fayle have given, granted, gifted, settled, estated, and
confirmed and by these present do give, grant, gift, settle, estate, and
confirm unto and upon him the said William Fayle his heirs and assigns
all and singular the whole of my right, title, interest, claim, and demand
that I now have or at any time hereafter may or can have of in and unto the
said estate lands and premises commonly called and known by the name of
Botchin in the parish of Marown aforesaid. Also all my right and title in
and to the whole of the intacks thereunto belonging and
adjoining. And the houses and buildings erected thereon. Bounded by the
rents of Robert Killy and Thomas Kelly on the south and west the
commons on the north and by east Botchin on the east and of such yearly rent
as the same bears. And all ways waters, water courses, easements,
liberties, rights, member and appurtenances to the same belonging or in any
wise appertaining to ---- and to hold the said hereby granted and settled
premises unto him the said William Fayle his heirs and assigns
from and immediately at and upon the death and decease of me the said Fayle
and from thenceforth for ever.
Yielding and paying yearly and every year the yearly rent aforesaid and
all dues, duties, rents, and services payable there out. And I the said
John Fayle do hereby leave and bequeath unto my daughter Elizabeth
Creer otherwise Fayle wife of Thomas Creer the sum of ten pounds
British as legacy.
I leave and bequeath to Charlotte Kennaugh otherwise Fayle wife of
William Kennaugh my daughter the sum of ten pounds British as legacy. And I
do hereby nominate ordain and appoint my nephews John Fayle and Robert
Shimmin of Douglas to pay the said sum of ten pounds British by installments
unto the said Charlotte Kennaugh as she may require the same.
I leave and bequeath to my daughter -------- Quine otherwise Fayle wife
of Robert Quine the sum of one pound British yearly and every year to be
paid unto her by the said William Fayle for and during her natural life.
I leave and bequeath to my daughter Ann Clucas otherwise Fayle wife of John
Clucas the sum of two pounds British as legacy.
I leave and bequeath to my daughter Mary Curphey othewise Fayle wife of John
Curphey the sum of two pounds British as legacy.
I leave and bequeath to my nephew John Fayle and William Shimmin and Robert
Shimmin the sum of five pounds British each as legacy. Also I
leave and bequeath to the said William Shimmin my Black Horse named Punch as
legacy.
I leave and bequeath to John Fayle son of the before mentioned John
Fayle the sum of two pounds British as legacy.
I leave and bequeath to the trustees of Crosby Chapel the sum of one pound
British and to the poor of the parish of Marown the sum of one pounds
British as legacy.
I leave the whole tuition and care of my granddaughter Charlotte
Kennaugh unto and upon my said son William Fayle for the term of two years.
And I the said William Fayle do engage and agree and bind myself
to keep support and maintain the said Charlotte Kennaugh in victuals and
clothing for the terms of two years form the date hereof.
And to put and place her to trade or business provided my father the
said John Fayle shall depart this life within the space of twelve months
from the date hereof. And if in case the said John Fayle shall survivor
and live two years from the date hereof that then and in that case the said
John Fayle to keep the said Charlotte Kennaugh at his cost and expense for
the said term of two years.
I leave and bequeath to all lawful claimers the sum of one shilling each
as legacy.
Lastly I do hereby nominate, ordain, and appoint my said son the said
William Fayle whole and sole executor of all the rest, residue, and
remainder of my goods, cash, credits, and effects moveable and immoveable of
what nature kind or denomination whatsoever and wheresoever. And I the said
William Fayle do hereby bind myself my
heirs and assigns to pay or cause to be paid the said herein and before
mentioned legacies twelve months after my father's decease. And I the said
John Fayle do hereby bind myself my heirs and assigns to keep support
maintain and defend the said William Fayle his heirs and
assigns in the just and peaceable possession of the said herein and
hereby granted premises from and against the claim challenge and
demand of all and every person and persons whomsoever forever. And for the
true and faithful performance hereof the parties to the same so far as they
and each of them are respectively concerned do hereby bind themselves their
heirs and assigns in the final sum of ten hundred
pounds British to be levied and paid according to law. As witness their
names and marks hereto the twenty sixth day of November in the year
one thousand eight hundred and thirty six. 1836.

29 Jan 1841 Wm Fayle junior sworn administrator in trust with the deed
of gift or will annexed to pay all the just debts and funeral expenses of
the late John Fayle deceased so far forth as the goods will extend and
the law bind them and to return a true and perfect inventory of the said
deceadents estate and effects to the Episcopal Registry of this Diocese when
thereto lawfully required. And to these ends Robert Lewin and
Edward Clark have become pledges for the said William Fayle Junior.
